---- 2/09.01.2026 Heard learned counsels for petitioners and learned counsels for the respondent State as well as the informant.

The petitioners are apprehending their arrest in connection with Barhi PS Case No.397 of 2025, for offence registered under sections 191(2), 190, 115(2), 109, 352, 351(2) of BNS, 2023, pending in court of learned Sub Divisional Judicial Magistrate, Hazaribagh.

Learned counsel for petitioners submits that both the sides are agnets and altercation took place due to land dispute and he also submits that for the land in question one Partition Suit being Partition Suit No.128 of 2022 has been instituted and there are case and counter case between both the parties and both the sides have received the injury.

appearing for the informant jointly oppose the prayer for anticipatory bail and submit that there are allegations of assault and the informant has also received the injury.

Considering that altercation took place due to land dispute and there are case and counter case between both the parties and for the land in question one partition suit has been instituted as aforesaid. It has been pointed out that both the sies are agnets. It has also been stated that in paragraph no.13 that there are no criminal antecedent against these petitioners, I am inclined to grant anticipatory bail to petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within four weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Sub-Divisional Judicial Magistrate, Hazaribagh, in connection with Barhi PS Case No.397 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
