Prayer in the present writ petition is to grant extension of two years lease period in consonance with clauses 10 and 38 of the terms and conditions of bid document (Annexure P-4) subject to increase of 10% rent/lease money. Prayer is also made to quash the Notice Inviting Tender dated 05.06.2026 (Annexure P-22), whereby the said bid has been put to re-tender for a period of three years. 1 Whether reporters of Local Papers may be allowed to see the judgment? 2 2. The work assigned to the petitioner was for running/leasing out of the restaurant comprising Kitchen, dining hall, reception, service area and store, 2nd floor of rest house comprising nine (9) rooms and one nine bedded dormitory and parking area situated in the ground floor of Atal Sadan Bhawan, Kullu (excluding parking space for five (5) vehicles), which would be clear from Annexure P-4 from 01.01.2023 onwards. 3. In pursuance of the offer of the Contract dated 12.08.2025 (Annexure P-5), the necessary lease deed was also entered into, which was executed on 24.12.2022 (Annexure P-6) from 01.01.2023 onwards. 4. Counsel for the petitioners has sought to argue that various facilities were not available in the premises and the statutory permissions were not given and the same were only completed by October, 2023 by the official respondents and therefore, he is entitled for grant of extension. 5. We have gone through the paper-book. Apparently, when the three-year period was expiring on 31.12.2025, the petitioners addressed the communication dated 07.11.2025 (Annexure P-19) to the Deputy Commissioner-cum-Chairman, Kullu Paramparik Sanskriti Samvardhan Smiti (Kullu Kala Manch Samiti), Kullu, Himachal Pradesh, for the extension of the lease 3 period for a further two years (i.e., for the period 01.01.2026 to 31.12.2027). 6. An order was passed on 13.02.2026 (Annexure P- 20), whereby the respondents were granted the extension of lease period for a period of six months upto 30.06.2026 with 10% increase in the existing lease money/rent to the petitioners. The petitioners were satisfied with the said extension and did not approach this Court. It was only on 01.06.2026 (Annexure P-21) that they had requested for another extension for a period of two years, and there is no challenge raised to the earlier order passed on 13.02.2026. 7. Apparently, on 05.06.2026 (Annexure P-22), a Notice Inviting Tender (NIT) was issued for a further period of three years and since the last date of submission is tomorrow, 24.06.2026, the present writ petition has been preferred. 8. In the peculiar facts and circumstances of the case, we are of the considered opinion that the arguments raised by the counsel for the petitioners that the statutory permissions were not in place and that a loss was caused to them, cannot be raised in the present writ petition. The petitioners’ remedy for damages lies in a Court of competent jurisdiction. Furthermore, once the Notice Inviting Tender (NIT) has been issued, and the 4 petitioners were satisfied with the previously granted six-month extension there is no scope for interference in Notice Inviting Tender Process (NIT) dated 05.06.2026 (Annexure P-22). Moreover, it is always open to the petitioner to participate in the tender process, in case he is interested to bid for the same alongwith others. 9. Resultantly, we dismiss the present writ petition, so also the pending miscellaneous application(s), if any, shall also stand disposed off accordingly. (G.S. Sandhawalia) Chief Justice (Bipin C.
