The present is the writ petition against the order dated 23.08.2025 passed by the learned Third Additional Principal Judge, Family Court, Durg in case No. 19 of 2024 whereby the application filed by the petitioner for execution of the attachment of movable and immovable 2 property of the respondent for recovery of an amount of Rs. 50 Lakhs pursuant to the judgment and decree dated 17.12.2018 passed in Civil Suit No. 332/2018 by the learned Principal Judge, Family Court, Durg, has been rejected and the execution proceeding filed by the petitioner has also been closed. There is a compromise decree passed by the learned Family Court on 17.12.2018 under the following terms. :- 1. आवेदक संतो ष क मार रय और आवेदिदक ቦኍमातो निहारिरक रय क संसं्ቇ सं उत्प्ቐ उक प ्ቔ अंश रय एवे आवेदिदक ቦኍमातो निहारिरक रय क भरण प षण क संबंध मा' आवेदक संतो ष क मार रय आवेदिदक ቦኍमातो निहारिरक रय क वेतोमा मा' 65,00,000/- रूपय (प)संठ लाख रूपय) द्ቇ एवे 01 जु लाई 2024 क 50,00,000/- रूपय (पचासं लाख रूपय) अंप प ्ቔ अंश रय क मा पर उसंक वेयस्क हा  तोक क1 अंवेधिध क लिलाय निकसं रᮆᯚक5 तो बं6क मा' नि7क्सं नि9प:जिजुट आवेदिदक ቦኍमातो निहारिरक रय क उसंक संर्ቌक बंतो हुय जुमा करय्ቇ। आवेदिदक ቦኍमातो निहारिरक रय  उक्तो 65,00,000/- रूपय (प)संठ लाख रूपय) क1 रलिश ቚኋप्तो कर ला हा)। 2. प ्ቔ अंश रय क मा पर जु रकमा 50,00,000/- रूपय (पचासं लाख रूपय) आवेदक संतो ष रय क ቛኋर 01 जु लाई 2024 तोक जुमा कर हा), उसंक ब्यजु प ्ቔ अंश रय क वेयस्क हा  तोक आवेदिदक ቦኍमातो निहारिरक रय ቚኋप्तो कर उसं प ्ቔ अंश रय क भरण प षण और उसंक1 लिश्ቌ दD्ቌ मा' ्ቤय कर्ቇ। 3. प ्ቔ अंश रय क वेयस्क हा  पर उक्तो नि7क्सं नि9प:जिजुट क1 संቘ኏Gण रलिश पर प ्ቔ अंश रय क पGर अंधिधकर हा ्ቇ। 4. 01 जु लाई 2024 मा' 50,00,000/- रूपय (पचासं लाख रूपय) प ्ቔ अंश रय क मा पर नि7क्सं नि9प:जिजुट निकय जु क संबंध मा' आवेदक्ቇणH क बंचा यहा भ तोय हुआ हा) निक यदिद आवेदक संतो ष रय उक्तो रलिश अंद हाI करतो हा) तो उक्तो रलिश इसं संमाझौLतो क आधर पर बं्ቇ)र क ई लिसंनिवेला वेद संቝኌNतो निकय संध निष्पद कयवेहा क ቛኋर आवेदिदक ቦኍमातो निहारिरक रय अंथवे अंवेयस्क प ्ቔ अंश रय वेयस्क हा  पर वेसंGला कर संक ्ቇ' तोथ तोदसंमाय आवेदक संतो ष रय क स्वेधिमात्वे क1 जु भ चाला-अंचाला संቘ኏ቈኌR हा ्ቇ. वेहा उक्तो रलिश क1 अंदय्ቇ क लिलाय उRरदय हा ्ቇ। 5. आवेदक्ቇणH क माध्य उक्तो रलिश क संबंध मा' यहा भ तोय हुआ हा) निक यदिद उक्तो रलिश 01 जु लाई 2024 क अंद हा हा तो हा) तो उक्तो रलिश पर आवेदक संतो ष क मार रय 01 जु लाई 2024 सं तोअंदय्ቇ तोक 09 ቚኋनितोशतो वेቧኌषUक क1 दर सं ब्यजु द्ቇ। 6. आवेदक्ቇणH क माध्य यहा भ तोय हुआ हा) निक ቚኋत्यक संप्तोहा क रनिवेवेर क दिद आवेदक संतो ष क मार रय प ्ቔ अंश रय सं द घंट क लिलाय 4 सं 6 बंजु क माध्य य तो आवेदक संतो ष क मार रय क घंर मा' य आवेदिदक ቦኍमातो निहारिरक रय क निवेसं N मा' य निकसं पक मा' धिमाला संक ्ቇ निकन्तो ऐसं धिमाला पर बंሴኔ क1 इስኋ, उसंक1 ख श संवे[पर हा ्ቇ। 7. आवेदक्ቇणH क बंचा यहा भ तोय हुआ हा) निक आवेदिदक ቦኍमातो निहारिरक 3 रय भनिवेष्य मा' अंप एवे अंवेयस्क प ्ቔ अंश रय क भरण प षण क लिलाय आवेदक संतो ष रय क निवेरू्ቍ क ई दवे हाI कर्ቇ तोथ आवेदक संतो ष रय क1 संቘ኏ቈኌR पर आवेदिदक ቦኍमातो निहारिरक रय क क ई अंधिधकर हा रहा्ቇ। 8. आवेदक्ቇणH क माध्य यहा भ तोय हुआ हा) निक आवेदक्ቇणH क वे)वेनिहाक जुवे क दLर आवेदिदक ቦኍमातो निहारिरक रय क मा पर जु भ संቘ኏ቈኌR हा) वेहा संቘ኏ቈኌR आवेदिदक ቦኍमातो निहारिरक रय क स्वेधिमात्वे क1 संቘ኏ቈኌR हा ्ቇ। उक्तो संቘ኏ቈኌR क संबंध मा' आवेदक संतो ष क मार रय भनिवेष्य मा' क ई दवे हा कर्ቇ। आवेदक संतो ष क मार रय क ቛኋर आवेदिदक ቦኍमातो निहारिरक रय क मा पर जु संቘ኏ቈኌR हा) उसंसं संबंधिधतो संቘ኏Gण क्ቇजुतो आवेदिदक ቦኍमातो निहारिरक रय क दिदय जु चा क हा)। 9. आवेदक्ቇणH क माध्य यहा भ तोय हुआ हा) निक प ्ቔ अंश रय उक्तो शतो] क अंध अंप अंवेयस्कतो तोक आवेदिदक ቦኍमातो निहारिरक रय क पसं हा रहा्ቇ और यदिद उसंक1 अंवेयस्कतो क1 अंवेधिध मा' आवेदिदक ቦኍमातो निहारिरक रय प निवेवेहा करतो हा) तो अंवेयस्क प ्ቔ अंश रय क आवेदिदक ቦኍमातो निहारिरक रय आवेदक संतो ष रय क अंቈኌभर्ቌ मा' सं^प्ቇ। 2. Pursuant to the order dated 12.03.2026, the petitioner Niharika Singh, respondent Santosh Kumar Rai and their son Ansh Rai present in person before this Court, the possibility of amicable settlement between the parties have been explored and the parties are ready to settle their dispute. 3. It is not in dispute that under the terms of the compromise decree, the amount of Rs. 65 Lakhs has already been paid to the petitioner by the respondent, the present dispute revolves around the non-payment of Rs. 50 Lakhs in the name of their minor son Ansh Rai. Presently, their son Ansh Rai has attained the majority on 11.01.2026. 4. Learned counsel appearing for the petitioner would submit that the amount of Rs. 50 Lakhs have not been deposited by the respondent in terms of the compromise decree for which the petitioner moved an application for attachment of the movable and immovable property of the respondent as per the clause No. 1 and 4 of the decree, the said application has been rejected by the learned executing Court on the ground that the respondent is already paying the interest over the 4 amount of Rs. 50 Lakhs as per clause No. 5 of the said decree, therefore, there is no need to pass any order regarding attachment of the movable and immovable property of the respondent. He would further submit that the very purpose for passing of the compromise decree would be frustrated if the principal amount has not been deposited by the respondent, therefore, the respondent may be directed to deposit the principal amount for the attachment warrant with respect to his movable and immovable property be issued by setting aside the impugned order. 5. On the other hand, learned counsel appearing for the respondent would submit that under clause No. 5 of the said decree, the respondent is paying interest at the rate of 9% over the amount of Rs. 50 Lakhs regularly without any single fault. He would further submit that the respondent is worried about misuse of the amount of Rs. 50 Lakhs for that reason he has not deposited the amount. Since, the son of the parties namely Ansh Rai has now become major, if he provided his bank account details, he is ready to deposit the said amount of Rs. 50 Lakhs in two installments. He would also submit that the first installment may be within two months and the second installment may be upto April, 2027, therefore, the attachment warrant may not be issued against him as he is ready to deposit the amount under the terms of the decree. He would further submit that considering the fact that he is already paying the interest over the amount, the learned executing Court has rightly dismissed the execution filed by the petitioner and therefore, the present writ petition may also be disposed of. 5 6. Looking to the controversy between the parties, the Co-ordinate Bench of this Court has ordered on 24.02.2026 that the parties shall remain present in person to explore the possibility of amicable settlement, if any. On 12.03.2026 also, the parties are directed to remain present before this Court. Today, the petitioner as well as the respondent and their son Ansh Rai appeared in person before this Court and explored the possibility of settlement. 7. After having conversation with the petitioner as well as respondent and their son and also after hearing the learned counsel appearing for the respective parties, it is agreed between the parties that under the terms of clause No. 1, 4 and 5 of the compromise decree dated 17.12.2018, the amount payable to the son of the parties namely Ansh Rai is to be paid in two installments by the respondent, the first installment of Rs. 25 Lakhs shall be paid by the respondent within two months from today in the bank account of the son of the parties Ansh Rai. During course of the hearing, the petitioner and Ansh Rai gave the details of the bank account of Ansh Rai which is being run by him in the IDBI Bank, Bhilai Branch by saving bank account No. 0048104000319423, the respondent shall deposit the said amount of Rs. 25 Lakhs within 2 months in the aforesaid bank account of IDBI Bank, Bhilai Branch. 8. The remaining amount of Rs. 25 Lakhs shall be deposited by the respondent upto the month of December, 2026. The respondent is further directed to pay the interest over the amount under the decree in terms of clause No. 5 of the said decree on the unpaid amount till its payment. The deposition of the amount shall be communicated to the petitioner as well as their son Ansh Rai through speed post mode on 6 the address of the petitioner as well as their son Ansh Rai mentioned as “27/6, Gurudwara Road, Nehru Nagar (West), Bhilai, District – Durg (Chhattisgarh)”. 9.
