This is an application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 whereby the petitioner, Chandan Nath has prayed for releasing him on bail after he was arrested in connection with Offence No. SP/30/2026-27 under Section 39/48-A/49(B) read with Section 2(2) (14)(20)(31) of the Wildlife (Protection) Act, 1972. 3. Mr. D. Gogoi, learned Special Public Prosecutor, Wildlife has produced before this Court the report of the forensic examination, which reveals that the seized article is not a rhino horn. 4. In view of the above, I am of the considered view that the petitioner named above shall be released on bail on furnishing a bail bond of Rs. 5,000/- with a local surety of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup(M). 5.
