This Court under its common judgment & order dated 27.08.2024 passed in WP(C) No. 4325/2012 and WP(C) No. 7378/2013, directed the Commissioner, Department of Education, Government of Assam to cause an inquiry as regard the allegation of the petitioner regarding the qualification of some selected candidates to the post of Deputy Director/Inspector of School/District Elementary Education Officer etc., wherein the petitioner did participate. Such exercise was to be carried out within a period of two months from the date of receipt of a certified copy of the order. 4. Alleging non compliance of the aforesaid order, the present contempt petition is filed 5. Mr. Sarma, learned counsel representing the respondent submits that he has received a written instruction from the Secretary to the Government of Assam, Department of School Education, which reflects the following:- “Further, with rgard to the first direction of the Hon’ble High Court in the Writ Petition. 4325/2012, to cause inquiry, it appears from the record that an Inquiry was made and Inquiry Report was also submitted on 10.12.24 and thereafter as per report of Inquiry Officer Show Cause/Charged under Rule 9 of the Assam Services (Discipline & Appeal) Rules, 1964 has also been issued. Hence, it appears that there is no willful violation of Hon’ble Court’s order and same appears to have been complied with.” 6. In view of the aforesaid, this Court is of the considered opinion that the common judgment and order dated 27.08.2024 passed in WP(C) No. 4325/2012 & another connected case is complied with. 7.
