VISAKHAPATNAM, ANDHRA PRADESH 530001. ...RESPONDENT(S): 2 Dr. YLR, J W.P.No.10940 of 2026 Dated 23.04.2026 Counsel for the Petitioner: SHAIK MEERAVALI Counsel for the Respondent(S): GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue an appropriate Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent Nos 2 and 3 in not considering the request of the Petitioner seeking to include either by amending or altering or adding the Sections of offences in CrimeFIR No 40 of 2026 dated 05 042026 which has been registered only under Section 194 of the Bharatiya Nagarik Suraksha Sanhita 2023 BNSS by ignoring complaint dated 05 04 2026 arising from the sustained harassment threats and abetment leading to the suicide of the Petitioners mother on 04 04 2026 serious offences disclosed under the Bharatiya Nyaya Sanhita 2023 BNS pending on the file of 4th Respondent and to speed up the investigation inspite of petitioners several requests and Personal approaches and further intiate a departmental action against the investigation officer is illegal arbitrary improper and unconstitutional and against the procedure contemplated under the code of criminal procedure and BNSS 2023 and 2023 and consequently the Respondent No 2 and 3 to consider petitioners representations/Complaints dated 26 03 2026 and 05 04 20296 seeking include either by amending or altering or adding the Sections of offences in FIR No 40 of 2026 pending on the file of the 4th Respondent and to speed up the investigation as per the law and also procedure contemplated under the code of criminal procedure and BNSS 2023 and take action as per the procedure contemplated under law and to file final report as per the law and to pass….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3. Mr. Shaik Meeravali, learned counsel for the petitioner, submits that the mother of the petitioner committed suicide due to continuous 3 Dr. YLR, J W.P.No.10940 of 2026 Dated 23.04.2026 harassment, threats, and abetment by certain third parties. The police have not registered a case under the appropriate provisions of ‘the BNSS’ and initially registered only a complaint under Section 194 of ‘the BNSS’, neglecting the complaint of the petitioner dated 05.04.2026. The petitioner is aged about 39 years and is enrolled as an advocate. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the Station House Officer, III Town Police Station, Visakhapatnam/respondent No.4 in the course of investigation, has altered the sections of law from Section 194 of ‘the BNSS’ to Sections 329(4), 351(2), and 108 read with Section 3(5) of ‘the BNSS’, and has submitted an alteration memo of the sections of law. In view of the same, the grievance of the petitioner stands addressed; hence, the Writ Petition is liable to be disposed of. 5. Considering the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, directing the Station House Officer, III Town Police Station/respondent No.4 to bring the investigation to a logical conclusion by filing appropriate proceedings before the learned jurisdictional Magistrate, in accordance with law, as early as possible. 6. With the above observations and directions, the Writ Petition is disposed of.
