This is the third bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 762/2025 registered at Police Station Khamtarai Raipur AKHILESH KUMAR DEWANGAN Digitally signed by AKHILESH KUMAR DEWANGAN
2 District Raipur (C.G.) for the offence punishable under Section 296, 351(2), 115(2), 118(2), 3(5) of Bharatiya Nyaya Sanhita (for short ‘BNS’). 2. Case of the prosecution, in brief, is that the complainant, Rahul Gendre, lodged a First Information Report at Police Station Khamtarai stating that on 11.07.2025, he along with his brother Naval Das Banjare and other companions were sitting and talking at a playground in Rawanbhatha at around 8:00 PM. At about 10:00 PM, the accused Hemraj Sahu and his associate Pramod Ghritlahare arrived there and started abusing Santosh Dhruv over a dispute regarding repayment of money and not taking him along for work. When the complainant and his brother intervened to pacify the situation, the accused persons began abusing them in filthy language and, upon being objected to, threatened to kill them. Thereafter, the accused assaulted the complainant and his brother with fists, and accused Hemraj Sahu took out a sharp iron knife and repeatedly stabbed both of them in their abdomen, causing serious injuries. Seeing blood coming out, the accused persons threw the knife and fled from the spot. On the basis of the report, Crime No. 762/2025 was registered against the accused persons under Sections 296, 351(2), 115(2), 118(2), 3(5) of the Bharatiya Nyaya Sanhita. Hence, the bail application. 3.
Learned counsel for the applicant submits that the first and second bail applications of the applicant were rejected by this
3 Court vide orders dated 25.09.2025 and 03.12.2025 passed in MCRC Nos.7067 of 2025 and 9818 of 2025, respectively on merits, therefore this second bail application is filed on the ground that out of 12 witnesses, the statement of only 3 witnesses, including the injured has been recorded, hence, the conclusion of trial is likely to take some time and the applicant is in jail since 13.07.2025 therefore, he prays for releasing the applicant on regular bail. 4. On the other hand, learned State counsel opposes the bail application and submits that charge-sheet has already been filed in the present case. He further submits that the present applicant is the main assailant in the case who assaulted the injured by a sharp edged weapon i.e. knife repeatedly stabbed the injured on his abdomen, causing grievous injuries to him, due to that the injured also underwent surgery. Therefore, the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6.
From perusal of the records, it transpires that this is the third bail application of the applicant, first and second bail applications of the applicant were rejected by this Court vide orders dated 25.09.2025 and 03.12.2025 passed in MCRC Nos.7067 of 2025 and 9818 of 2025, respectively on the ground that the present applicant is the main assailant, who assaulted the injured by a
4 sharp edged weapon i.e. knife repeatedly stabbed the injured on his abdomen, causing grievous injuries to him, due to which, the injured also underwent surgery, so far as the status of trial is concerned, out of 12 witnesses, the statement of 3 witnesses, including the injured has been recorded, who too along with other deposed against the applicant and supported the prosecution case, further there appears to be no new or good ground to entertain the present bail application. 7. Accordingly, the second bail application of the applicant- Hemraj Sahu, involved in Crime No. 762/2025 registered at Police Station Khamtarai Raipur District Raipur (C.G.) for the offence punishable under Section 296, 351(2), 115(2), 118(2), 3(5) of BNS, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and concluded the trial expeditiously. 9. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
