This appeal is filed under Section 14-A(2) of the SC & ST (Prevention of Atrocities) Act, 1989 for grant of regular bail to the appellant as he is arrested in connection with Crime No. 122/2025 registered at police station Sonhat, District Koriya (C.G.) for commission of offence punishable under Section 103(1) of BNS and Section 3(2)(V) of SC & ST (Prevention of Atrocities) Act. 2. As per the case of the prosecution, it is alleged that the accused had teased the daughter of deceased Amarjeet HEERA LAL SAHU Digitally signed by HEERA LAL SAHU Date: 2026.02.17 17:55:03 +0530 2 Singh and had circulated her photographs, whereupon a complaint was lodged at the police station Sonhat on 25.09.2025. Pursuant thereto, on 26.09.2025, Ram Giri along with Amarjeet Singh, went to the police station to lodge the report. While returning, within about 2 km near Guru Ghasidas National Park, the accused allegedly and intentionally dashed into their Hero Honda Motorcycle (CG- 16-CS-2213) with his pickup vehicle (CG-16-CU-8828), causing grievous injuries resulting in the death of Ram Giri and Amarjeet Singh. Based on this, offence has been registered against the present appellants. 3. By order dated 08.01.2026 passed by the learned Special Judge in Crime No. 122/2025, the bail application filed by the appellant has been rejected against which the appellant has filed this appeal. 4. Learned Counsel appearing for the Appellant submits that the Appellant is innocent and has been falsely implicated in the case, due to previous enmity. He further submits that it has been alleged that the incident occurred by collision of a pickup vehicle with a motorcycle, resulting in the death of Ram Giri and Amarjeet Singh, however, no independent witness has seen the appellant/accused driving the said pickup vehicle at the relevant time. The prosecution case regarding the alleged act of teasing of the daughter of deceased Amarjeet Singh by the appellant is based only on allegations, and the FIR in relation thereto was lodged on 02.11.2025 at police station Sonhat bearing crime No. 01/2025 on the basis of a written complaint and the same has been developed only to implicate the appellant to show the motive in the present case. He lastly submits that charge sheet has been filed, the appellant is in jail since 29.09.2025, and the trial is likely to take considerable time 3 to be finalised; therefore, it is prayed that the appeal may be allowed and the appellant may be released on bail. 5. On the other hand, learned Counsel appearing for the State opposes the bail application and submits that there is sufficient evidence available on record against the Appellant. The trial has not commenced yet and the matter is a double murder case; therefore, at this stage, the Appellant may not be enlarged on bail. 6. I have heard learned Counsel appearing for the parties and perused the documents available on record. 7. Considering the totality of the facts and circumstances of the case, and also looking to the gravity of the offence and the evidence collected by the prosecution against the appellant, and the trial has not commenced yet, at this stage, I am not inclined to release the appellant on bail. 8. Accordingly, the appeal is dismissed. 9. Office is directed to sent a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
