JUSTICE KAUSHIK GOSWAMI ORDER 26.08.2026 Heard Mr. H A Laskar, learned counsel for the petitioner. Also heard Mr. S M T Chistie, learned counsel for all the contemnors. The present contempt petition has been filed alleging non-compliance of the order dated 06.09.2024 passed by this Court in WP(C) No. 4488/2024. The relevant portion of the aforesaid order reads as under: “6. Accordingly, this writ petition is disposed of directing the petitioner to file a fresh representation to the concerned Inspector of Schools along with a certified copy of this order within a period of ten days from today. Thereafter, the concerned Inspector of Schools shall make necessary verification as to whether the petitioner has obtained B. Ed degree from UGC recognized University and NCTE approved B. Ed college and has joined the institution before 03.07.2012 and upon verification, if it is found that the petitioner has the required qualification as mentioned in the Communication, dated 21.07.2016, the respondent-authorities shall take appropriate steps for granting one advance increment to the petitioner within a period of three months from the date of submission of the representation.” Today, when the matter is called upon, Mr. S. M. T. Chistie, learned counsel appearing for the alleged contemnors, places on record the Speaking Order dated 25.08.2026 issued by the Office of the Inspector of Schools, Silchar, pursuant to the instructions dated 26.08.2026 issued from the Office of the Director of Secondary Education, Assam. A copy of the said Speaking Order has been taken on record and marked as “X” and has also been furnished to the learned counsel for the petitioner. A perusal of the said Speaking Order indicates that the representation submitted by the petitioner has been considered and the relevant service records have been examined. Upon such consideration and verification, the petitioner has been held not entitled to one Page No.# 3/3 advance increment in terms of the Communication dated 21.07.2016, and the representation has accordingly been disposed of. In view of the aforesaid action taken by the respondentauthorities, the direction contained in the order dated 06.09.2024 passed by this Court stands complied with. This Court, in the present contempt proceedings, is concerned only with the question of compliance of the direction issued in the aforesaid order and not with the correctness or otherwise of the decision taken pursuant thereto. Accordingly, nothing further survives for adjudication in the present contempt petition and the same stands closed. The notice issued to the alleged contemnors stands discharged. It is, however, clarified that closure of the present contempt proceedings shall not preclude the petitioner from assailing the aforesaid Speaking Order dated 25.08.2026, if so advised, before the appropriate forum, in accordance with law. All questions relating to the legality, validity or correctness of the said Speaking Order are left open. JUDGE Comparing Assistant
