Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has, inter alia, prayed for the following relief:- “i. That appropriate writ, order or direction may very kindly be issued and impugned order (Annexure P-4) dated 29.12.2025 may very kindly be quashed and set aside with further direction to the respondent to allow the petitioner to continue performing his duties at HPPWD Sub-division Sach-II, Distt. Chamba, H.P. in the interest of law and justice.” 2. By virtue of the interim order that was passed by this Court, though the petitioner is presently serving at Sach, District Chamba, H.P., but the present respondent is serving their already. On the last date of hearing, the following order was passed by the Court:- “Learned Senior Counsel appearing for the petitioner submits that despite a stay having been granted by 1 Whether reporters of the local papers may be allowed to see the judgment? 2 Hon'ble Coordinate Bench on 02.01.2026 of the impugned office order, yet the State is still permitting respondent No. 2 to continue to serve at the said station in violation of the Court order. Learned Additional Advocate General to have instructions as to whether both the petitioner and the private respondent are stationed at the same station and if yes, whether there is one vacancy or more of Assistant Engineer (Civil) at the station. List on 23.06.2026.” 3. In terms of the instructions imparted the Court stands informed that the petitioner as well as private respondents are both stationed at Sub-Division Sach-II, District Chamba, H.P. 4. In light of the fact that the petitioner is to superannuate on 31.08.2026, this petition is disposed of by putting in abeyance the impugned transfer order upto 31.08.2026, with further direction that the private respondent shall report for his duty in the interregnum at the said station where he was posted before the impugned order was passed and immediately on the superannuation of the petitioner, the private respondent shall be posted at Sach, where he shall be allowed a normal tenure. 5.
