This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.217/2024 registered at Police Station Pandri, Distt. Raipur (C.G). for the offence punishable under Sections 109, 351 (3) R/w 3 (5) of BNS and 25 & 27 of Arms Act. 2. Case of the prosecution, in brief, is that on 06.07.2024 at about 11:00 GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.01.07 19:01:59 +0530 2 P.M., the complainant Ishrat Khan lodged a complaint that, when he was on duty (guard in Mahavir Hospital) then he saw the applicant and the co-accused Parth Sahu holding and dragging the victim Kaushik Rana and the applicant stabbed the victim with a knife on his stomach, and the co-accused (Parth Sahu) hit the victim on his head with a brick, in scuffle between them when victim got an opportunity he ran away from there, then both the accused followed the victim. Based on the said complaint the FIR was registered. 3. Learned counsel for the applicant submits that the applicant is said to caused injuries to the injured by knife in his abdomen. He would submit that charge sheet has been filed, the applicant is in jail since 06/07/2024 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submitted that the applicant has assaulted the injured in his abdomen by knife which stuck in his abdomen and the injury was found to be grievous in nature and dangerous to life, therefore he is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, considering the fact that the applicant has assaulted the injured in his abdomen by knife which stuck in his abdomen and the injury was found to be grievous in nature and dangerous to life, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 3 7. Accordingly, the bail application of applicant Hiravan Sahu involved in Crime No.217/2024 registered at Police Station Pandri, Distt. Raipur (C.G) for the offence punishable under Sections 109, 351 (3) R/w 3 (5) of BNS and 25 & 27 of Arms Act, is rejected. 8.
