Also heard Mr. R.R. Kaushik, learned Additional Public Prosecutor for the State respondent. 2. This application under Section 483 of the BNSS, 2023 is preferred praying for granting bail to the accused-applicant in connection with Sivasagar P.S. Case Page No.# 2/2 No. 93/2026 under Sections 308(4)/351(4) of the BNS, 2023, added Sections 25(1A)/27 of the Arms Act, read with Section 3(5) of the BNS, 2023. 3. This is the second bail application moved by the accused-applicant and the earlier bail application, being Bail Application No. 1841/2026, was rejected by this Court, vide order dated 24.07.2026, after consideration of the case diary. 4. Mr. Mahajan, learned counsel for the accused-applicant submits that the accused-applicant is behind the bar for last 95 days and therefore, he is eligible for default bail. 5. Mr. Kaushik, learned Additional Public Prosecutor confirms that the charge- sheet has not yet been submitted. 6. Taking into account of the aforesaid, this Court directs that the accused- applicant shall immediately be released on furnishing a bond of Rs. 30,000/-, with surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Sivasagar, however, subject to the condition that the accused- applicant shall co-operate with the investigation and make himself available as and when required by the investigating authority. 7.
