THIS PETITION, COMING ON FOR HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE V SRISHANANDA ORAL ORDER 1. After addressing the arguments for sometime, a memo came to be filed by the both the parties. Memo reads as under: "The undersigned counsel for the petitioner and respondents submits that in view of settlement urge between the parties. The accused / petitioner is agreed to pay the sum of Rs.2,17,000/- (Two Lakhs seventeen thousand) out of that the petitioner herein already deposited of Rs.1,42,000/- on 14/09/2015 and on 24/12/2018 before the Trial Court, now it is submitted that the petitioner /accused agreed to pay the balance of amount Rs.75,000/- (Seventy Five Thousand) in two installment on 1st installment will be paid on 17/05/2026 and another IInd installment will be paid on 2/6/2026 the installment as follows: Ist installment - Rs.40,000/- IInd installment - Rs.35,000/- Rs.75,000/- - 3 - HC-KAR NC: 2026:KHC:22413 CRL.RP No. 1390 of 2018 Wherefore the petitioner/accused pray that this Hon'ble Court may kindly be accepted the Memo dispose the above case accordingly in the interest of justice." 2. Amount in deposit is ordered to be withdrawn by the complainant under due identification. 5. It is made clear that if the balance amount of compensation as agreed in the memo is not paid and if there is any single default, the petitioner shall undergo imprisonment ordered by Trial Magistrate confirmed by the First Appellate Court.
