Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record. This application under Section 529 BNSS has been filed seeking direction to the court concerned to expedite the hearing of Case no. 17946 of 2025 (State vs. Pradeep Kumar Pathak), arising out of Case Crime no. 117 of 2025, under Sections 318(4), 316(2) BNS, Police Station Civil Lines, District Aligarh pending before the court of learned Chief Judicial Magistrate, Aligarh, expeditiously within stipulated period. Learned counsel for the applicant submits that cognizance upon the charge sheet has been taken on 23.05.2025 and summons issued to accused persons to face trial under the aforesaid sections, but till date, trial is still pending. Looking to the aforesaid circumstances, it is directed that trial pending before the concerned court be concluded expeditiously, as early as possible, in accordance with the provisions of Section 309 of the CrPC (Power to postpone or adjourn proceedings) corresponds to Section 346 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, without granting any unnecessary or long adjournments to either of the parties, if there is no legal impediment.
