Affidavit-of-Service as filed on behalf of petitioner, is taken on record. 2. The writ petitioner, respondent/State and its instrumentalities are represented by their respective learned counsels. 3. None appears on behalf of the private respondents, despite service. 4. At the time of hearing, learned counsel appearing on behalf of the writ petitioner submits that it is the specific grievance of the writ petitioner that in respect of Plot No.4800 (having area of 3.09 acres) in Mouza Bisannanagar, P.S. - Beldanga, District – 2 Murshidabad, the private respondents are illegally and unauthorizedly filling up the waterbody particulars of which has been mentioned in the writ petition as well as in Annexure “P/1”. 5. Drawing attention to page no.45 onwards to the writ petition, it is further submitted that despite submission of several representations, the concerned jurisdictional B.L. & L.R.O. has not taken any steps to prevent such illegal conversion, as alleged. 6. In view of such, it is submitted that appropriate relief/reliefs may be granted to the writ petitioner in terms of the prayer made in the instant writ petition. 7. Mr. Chatterjee, learned counsel appearing on behalf of the respondent/State, in his usual fairness, submits before this Court that the jurisdictional B.L. & L.R.O. i.e. Beldanga – 1, District Murshidabad may be directed to consider the representation of the writ petitioner, in accordance with law. 3 8. In view of the submission made at the bar, this Court while disposing the instant writ petition, permits the writ petitioner to resubmit its representation dated 25.02.2026 with the B.L. & L.R.O., Beldanga – 1, P.S. – Beldanga, District – Murshidabad alongwith a server copy of this order. 9. The said B.L. & L.R.O. on receipt of such representation, shall consider the representation of the writ petitioner in accordance with law and after giving due opportunity of hearing to the writ petitioner and/or the private respondents and/or other stake holders, if there be any, shall pass a reasoned order and shall forthiwth communicate the same to the writ petitioner, private respondents and the other stake holders, if there be any. 10. The entire exercise, as indicated hereinabove, shall have to be completed by the said B.L. & L.R.O. within 120 working days from the date of communication of the server copy of this order. 4 11. The time-limit, as fixed by this Court, is peremptory and mandatory. 12. It is, further made clear that in the event while passing the reasoned order, the said B.L. & L.R.O. finds sufficient merit in the representation of the petitioner, he is directed to take all consequential action forthwith thereafter. 13. With the aforementioned observation, W.P.A. (P) 173 of 2026 stands disposed of. 14. Before parting with, it is, however, made clear that while disposing the instant writ petition, we have not gone into the merits of the instant writ petition and thus, all points are kept open for adjudication by the aforementioned B.L. & L.R.O. 15.
