10,85,889.46 along with interest was passed by the trial Court on 03.10.2025 against the peoners herein in the suit filed by the respondent – M/s Peacock Tex India. Peoners filed appeal and moved applicaon under Order 39 Rules 1 & 2 CPC for staying the execuon of the decree. The Appellate Court by way of the impugned order dated 10.04.2026 (Annexure P-3) directed the peoners to deposit the enre principal amount along with interest as awarded by the trial Court in the form of FDR within 45 days from the date of the order, i.e. 10.04.2026. 2. By way present revision peon, aforesaid order is assailed. 3. However, learned counsel for the peoners submits that instead of FDR, in order to secure the decreetal amount, the peoners are ready to place on record the original sale deed dated 25.03.2010 (copy Annexure P-4) in respect of vacant plot, which had been purchased by peoner No.2 for consideraon of
21,50,000/- and which shall cover the decreetal amount as well as the interest. 4. The present revision peon is hereby disposed of with liberty to the peoner to make this prayer before the Appellate Court.
