2026:JHHC:6454 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No.1270 of 2026 ----- Budheswar Oraon @ Budeshwar Oraon, son of Mahali Oraon, resident of Village Gindra Konatoli, P.O. & P.S. Gumla, District Gumla, Jharkhand. … … Petitioner Versus The State of Jharkhand. … … Opposite Party ----- CORAM : SRI ANANDA SEN, J. ----- For the Petitioner(s) : Mr. Vishal Srivastava, Advocate. For the State : Mr. Rajneesh Vardhan, A.P.P. ----- 02/ 10.03.2026 At 10:30 A.M. The concerned Authority is directed to procure the report by 02:15 P.M., as to how many witnesses have been examined and how many witnesses are still left to be examined. Later on at 02:15 P.M. The report has been procured. This Bail Application under Section 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been filed to release the petitioner on regular bail in connection with Gumla P.S. Case No.343 of 2024, corresponding to G.R. Case No.35 of 2025, for offence under Section 309(4) of the Bharatiya Nyaya Sanhita (BNS), 2023. The case is presently pending before the Court of learned Chief Judicial Magistrate, Gumla. 2. Heard learned counsel representing the petitioner and learned A.P.P. representing the State. Perused the material available on record and also gone through the impugned order. 3. Learned A.P.P. representing the State opposes the prayer for bail. 2026:JHHC:6454 2 4. Earlier, the bail application of the petitioner was rejected by a Coordinate Bench of this Court vide order dated 30.07.2025 in B.A. No.1522 of 2025. 5. The allegation against the petitioner is that when the informant was having photo session with his friends with his Bullet motorcycle, the petitioner along with other accused persons came to them and snatched the key of motorcycle on the point of pistol and thereafter assaulted them. They have also snatched their mobile phones and fled away with the Bullet motorcycle of the informant. 6. Though the petitioner is not named in the F.I.R. but the looted motorcycle was recovered from the possession of this petitioner. 7. Further, though as per the contention of petitioner’s counsel, one of the co-accused from whose possession, an allegedly looted Vivo Mobile set, was recovered, has been released on bail but since the looted motorcycle was recovered from the possession of this petitioner and the fact that out of 12 prosecution witnesses, 04 prosecution witnesses have already been examined in this case, I am not inclined to release this petitioner on bail at this stage. 8. Accordingly, this Bail Application is dismissed. 9. It is expected that the trial will be concluded within six months. (ANANDA SEN, J.) 10th March, 2026 Prashant. Cp-3 Uploaded on 13.03.2026
