JUSTICE BIPIN GUPTA Judgment / Order 07/08/2026 1. The present bail applications have been filed under Section 483 BNSS, 2023 against the orders dated 26.05.2026 and 20.05.2026 respectively passed by learned Sessions Judge, Karauli Rajasthan, in Criminal Misc. Case No (CIS).246/2026, and 235/2026 respectively, whereby the bail applications of the [2026:RJ-JP:31079] (2 of 3) [CRLMB-8968/2026] petitioner were rejected in connection with two F.I.R.s bearing Nos. 84/2024 & 163/2022 registered at Police Station Kudgaon, District Karauli for the offences under Sections 420, 409, 467, 468, 471, 120 B, 201, 166 of the IPC, 1860. 2. Learned counsel for the petitioners submits that the petitioner is in custody since 16.05.2026 and 13.05.2026, respectively in the matters. He submits that the challan in the case has already been filed and there are no criminal antecedents against the petitioners except the present two F.I.R.s. Learned counsel for the petitioner further submits that the amount involved in dispute has already been deposited by the petitioner and the same has been refunded back to the Gram Panchayat. Moreover, the conclusion of trial will take sufficiently long time and even the offences are triable by a Magistrate, therefore, he prays that the petitioner may be enlarged on bail. 3. Learned Public Prosecutor vehemently opposes the bail application. 4. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the material available on record. 5. Without expressing any opinion on the merits of the case and upon consideration of the submissions advanced, and particularly the fact that challan has been filed; all the offences are triable by Magistrate; the conclusion of trial is likely to take a considerable time; further the fact that the amount alleged to be misappropriated has already been deposited by the petitioner with the Gram Panchayat; there are no criminal antecedents except the present two F.I.R.s against the accused-petitioner, this Court is of the opinion that the bail application deserves to be accepted. [2026:RJ-JP:31079] (3 of 3) [CRLMB-8968/2026] 6. Consequently, the bail applications are allowed. It is ordered that the accused-petitioner - Rekha W/o Vijay Singh arrested in connection with two F.I.R.s bearing Nos. 84/2024 & 163/2022 registered at Police Station Kudgaon, District Karauli, shall be released on bail; provided he furnishes a personal bond of Rs.1,00,000/ (Rs.
