THOTA S V L NARASIMHASWAMY Counsel for the Respondent(S): 3 1. GP FOR SERVICES I The Court made the following: 4 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.28738 of 2026 ORDER: 1. The present Writ Petition is filed questioning the action of the Respondents in not considering the candidature of the Petitioner for appointment to the post of Village Revenue Officer (Grade-II) under A.P. Village Revenue Officers Service Rules, 2008, notified vide Notification No.Ser.IV(1)/216/2019, dated 26.07.2019, on account of non-submission of the Agency Area (Nativity) Certificate by the Petitioner, as illegal and arbitrary. 2. A general recruitment notification was issued by the Revenue Department, Government of Andhra Pradesh, vide Notification No.Ser.IV(1)/216/2019, dated 26.07.2019, for filling up 2880 posts of Village Revenue Officers (Grade-II) under the A.P. Village Revenue Officers Service Rules, 2008. The Petitioner, being a native of Sominaiduvalasa, Komarada Mandal of Vizianagaram District, and having the requisite educational qualifications, had applied for the said post and was qualified in the written examination conducted for the said post. 3. Thereafter, the Petitioner was called upon for certificate verification and was asked to submit the latest Agency Area (Nativity) 5 Certificate issued by the concerned Tahsildar. However, the Petitioner could not produce the same, as the said certificate was not being issued by the concerned Revenue Authorities and, as a consequence, he was denied appointment to the said post. Questioning the same, the Writ Petition is filed. 4. Learned counsel for the Petitioner submitted that the issue of requirement of submission of the Agency Area (Nativity) Certificate was considered by a coordinate Bench of this Court in W.P.Nos.24867, 24865 and 25534 of 2021, wherein this Court vide its orders, dated 19.12.2024 had directed the Respondents therein to consider the candidature of the Petitioners therein for appointment as Secondary Grade Teachers (Telugu) as per the notification therein, without insisting the Petitioners therein to produce the Nativity (Agency Area) Certificate. 5. It was further submitted that the said order, dated 19.12.2024, was confirmed by a Division Bench of this Court vide its orders, dated 31.01.2023, in W.A.Nos.118 of 2023 and 157 of 2023. In the light of the said Judgments, learned counsel for the Petitioner seeks reconsideration of the case of the Petitioner for appointment to the post of Village Revenue Officer (Grade-II), as there are sufficient vacancies which are left unfilled. 6 6. Learned Assistant Government Pleader for Services–I submitted that the impugned notification pertains to the year 2019 and the present Writ Petition is filed after a lapse of 07 years, without explaining the delay. It is further contended that no representation was given by the Petitioner in written form to the concerned authorities to substantiate his claim, nor was any impugned order passed by the Respondent-Authorities. 7. Heard Sri Thota S.V.L.N. Swamy, learned counsel for the Petitioner as well as learned Assistant Government Pleader for Services–I. 8. Considering that the delay in filing the present Writ Petition is only to the detriment of the Petitioner, as it is claimed that the candidature of the Petitioner for appointment to the post of Village Revenue Officer (Grade-II) was rejected on account of non-submission of the latest Agency Area (Nativity) Certificate, it would be appropriate to direct the Petitioner to submit a representation to the concerned authorities. Accordingly, with the consent of learned counsel appearing on both sides, this Writ Petition is disposed of at the admission stage, with the following directions:- 7 (i) The Petitioner shall submit a representation to the Respondent-Authorities for consideration of his case for appointment to the post of Village Revenue Officer (Grade-II) and explaining his claim, taking note of the Judgments of this Court in W.P.Nos.24867, 24865 and 25534 of 2021 and W.A.Nos.118 of 2023 and 157 of 2023. (ii) Upon receipt of the representation, the Respondent-Authorities are directed to consider the same and to pass appropriate orders within a period of three months from the date of receipt of a copy of this order. 9. No order as to costs. 10. As a sequel, miscellaneous petitions, pending if any, shall stand closed. ________________________ JUSTICE NYAPATHY VIJAY Date: 06.10.2026 chs 8 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY 122 WRIT PETITION No.28738 of 2026 Dated: 06.10.2026 chs
