Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner along with the co-accused persons, has committed murder of Nayeem Miya @ Mannu and Kalim Khan. It is submitted that the allegation against the petitioner is false and the petitioner is not named in the FIR and has been implicated in this case only on the basis of the confessional statement of the co-accused and his self-confessional statement and even going by the confessional statement of the three accused persons of the case, since the deceased persons were criminals and on earlier occasion, they were harassing the friends of the petitioner, who are the co- accused persons and severely assaulted one of co-accused namely Deepak Minz and were disturbing the co-accused Raushan Minz by breaking the lock of his house, hence, to save his friends from the torture perpetrated by the
deceased, the petitioner along with the co-accused committed murder. It is further submitted by learned counsel for the petitioner that the petitioner has no criminal antecedent, as mentioned in paragraph 19 of the bail application and charge sheet has been submitted against the petitioner in this case.
