JUSTICE PARTHIVJYOTI SAIKIA O R D E R 25.08.2026 Heard Mr. L.R. Mazumder, the learned counsel appearing for the petitioners. Also heard Mr. S.D. Purkayastha, the learned counsel representing the respondents. Page No.# 6/7 2. This is an application under Article 227 of the Constitution of India challenging the order dated 01.02.2025 passed by the learned Civil Judge (Jr. Divn.) No.3, Cachar, Silchar in Misc. Case No.155/2024 praying for reviewing of the order dated 03.08.2024. 3. Three persons, namely – Md. Ayajul Ali Mazumder, Md. Nijam Uddin Mazumder and Md. Sayed Raja Mauzumder had filed the suit being T.S. 102/1995 against Abdul Nur Mazumder praying for a decree of specific performance of concluded contract dated 25.04.1995. 4. During pendency of the suit, Md. Ayajul Ali Mazumder expired. Therefore, his successors filed an application under Order 22 Rule 3 of the Code of Civil Procedure and under Order 6 Rule 17 of the said Code as well as under Section 5 of the Limitation Act praying for condoning the delay in filing the said petition under Order 22 Rule 3 as well as for impleading the legal heirs of Ayajul Ali Mazumder. 5. The said petition was rejected by the trial court. The trial court held that the petitioners failed to show sufficient cause and accordingly the delay was not condoned. 6. A review petition was filed, which was registered as Misc. Case No.155/2024. That review petition was also rejected. 7. I have considered the submissions made by the learned counsels of both sides. 8. There is no doubt that with the death of Ayajul Ali Mazumder, the suit abated against him. Therefore, his legal heirs before praying for impleadment in his place, should have filed a prayer for setting aside the said abatement. 9. Regarding the rejection of the prayer under Section 5 of the Limitation Act, this Court is of the opinion that the learned trial court has failed to exercise his judicial mind. It appears that the long pendency of the suit has been taken up as a ground for rejecting the prayer. It is a settled position of law that while considering a prayer Page No.# 7/7 under Section 5 of the Limitation Act, courts are required to be liberal. A strict approach is not required to that effect. The learned trial court had held that there was a delay of 52 days in filing the said petition under Section 5 of the Limitation Act. Even then, the court had taken a strict approach while dealing with the matter. 10. Under the aforesaid circumstances, this Court is of the opinion that the order dated 03.08.2024 passed in Petition No.71/2001 is not a well reasoned judicial order. Accordingly, the said order along with the order dated 01.02.2025 passed by the learned Civil Judge (Jr. Divn.) No.3, Cachar, Silchar in Misc. Case No.155/2024 are set aside. 11. The petitioners shall file a formal prayer to set aside abatement in respect of late Ayajul Ali Mazumder. Thereafter, the trial court shall pass a fresh order in respect of the Petition No.71/2001 filed under Order 22 Rule 3 of the Code of Civil Procedure and under Section 5 of the Limitation Act. Before disposal of the said petition, both sides shall be given the opportunity of being heard. With the aforesaid direction, the civil revision petition is disposed of. JUDGE Comparing Assistant
