1. Petitioner has filled this petition seeking the following reliefs:-
“(1) Stay the operation, implementation and effect of the transfer order dated 07/06/2025 (Annexure-P/1), the order dated 21/07/2025 and also the order 12/09/2025 (Annexure-P/3), during the pendency of the present writ petition; (ii) Direct the respondents not to give effect to the said transfer order and permit the petitioner to continue at his present place of posting and to release his salary which has been withheld by the Respondents. (iii) Pass any other order(s) which this Hon'ble Court may deem just and proper in the facts and circumstances of the case.”

Learned counsel for petitioner submits that under rationalization scheme, petitioner has been declared to be surplus at Government Middle School, Pisaud, Block – Baloda, District – Janjgir-Champa and is transferred to Middle School, Kachanda, Block – Jaijaipur, District – Sakti. He contended that initially this order was put to challenge in WPS No.5158 of 2025, which was disposed of permitting petitioner to submit representation before the Committee under Rationalization Policy and till decision of the representation is communicated to petitioner, the order of transfer has been kept in abeyance. Petitioner submitted representation before the District Level Committee, which came to be dismissed, against which, he submitted representation before the Divisional Level Committee, which also came to be dismissed and thereafter, petitioner has submitted representation before the Appellate Committee of State Level of which the Director Public Instruction is the Chairman. Representation was submitted on
3 25.09.2025, however, till date, the said representation is pending
consideration, therefore, direction be issued to State Level Committee to take decision on the pending representation submitted by petitioner expeditiously within specified time. He also submits that salary of the petitioner has also been withheld.
3. Learned State counsel submits that in view of the limited prayer made by learned counsel for petitioner, he is having no objection. If the representation submitted by petitioner is still pending consideration, it will be considered in accordance with law.

On due consideration of the submission of learned counsel for parties further considering that representation submitted by petitioner dated 25.09.2025 stated to be pending consideration before the Committee of State Level constituted under Rationalization Policy, without entering into merits of this case this writ petition is disposed of directing respondent No.2 to take decision on the representation dated 25.09.2025 submitted by petitioner expeditiously preferably within further period of two weeks from the date of receipt of this order.

At this stage, learned counsel for petitioner submits that Block Education Officer/respondent No.9 had written letter to respondent No.7 for releasing of salary, however, respondent No.7 has not taken any decision on the said letter, therefore, a direction be issued to respondent No.7 to take decision on the letter of respondent No.9.
6. On due consideration on the submission of learned counsel for petitioner, respondent No.7 is also directed to take decision on the letter of respondent No.9 in accordance with law expeditiously
4 preferably within further period of two weeks from the date of receipt of
order.
7. With the aforesaid observations and directions, this writ petition stands
