This contempt petition is filed alleging the willful disobedience of the interim order dated 26.09.2023 passed in W.P.No.21723/2023. The assertion made in the petition is that in violation of the status quo order granted by this Court, accused Nos.1 and 2 have demolished item No.1 of the suit schedule property. 2. The accused entered appearance and filed the counter to the contempt petition. The contention of the accused is that accused No.1 acquired the right under the Will dated 06.07.1998. By virtue of the said Will, accused No.1 executed a gift deed in respect of item No.1 in favour of accused No.2 on 16.09.2021 and in respect of item No.2 on 22.09.2021. It is further asserted that accused No.2 has sold item No.1 of the suit schedule property in favour of the third party on 18.04.2023. - 4 - HC-KAR NC: 2026:KHC:8814-DB C.C.C. No.1179/2023 3. We have perused the assertions made in the complaint and the counter. 4. The interim order granted by this Court is dated 26.09.2023, wherein, the parties are directed to maintain the status quo. In a suit, the petitioner is challenging the aforesaid gift deeds and also it is brought to our notice that now the purchaser is arrayed as a party in the suit. Taking note of the said assertion, we are of the considered view that the contempt petition is required to be closed without expressing any opinion on the merits of the case, taking note of the fact that as on the date of granting of the interim order by this Court, the property was owned by the third party by virtue of sale deed dated 18.04.2023. The contempt proceedings are dropped, keeping all the contentions open to be urged in the pending writ petition and in the suit. 5. Notice issued to the accused shall stand discharged. 6.
