HIGH COURT OF JUDICATURE AT ALLAHABAD CONTEMPT APPLICATION (CIVIL) No. - 6235 of 2026 Court No. - 53 HON'BLE VIKAS BUDHWAR, J. 1. The present contempt application has been preferred alleging wilful defiance of the order dated 24.12.2024 passed by the Writ Court in Matter under Article 227 No. 13402 of 2023, the operative portion whereof is quoted hereunder:— "Heard learned counsel for the petitioner and perused the record. By means of this petition under Article 227 of the Constitution, the petitioner has prayed for a direction for disposal of pending restoration application no. 40 of 2016 in respect of the decree passed in O.S. No. 2819 of 2012. It is contended that the plaintiff/ opposite party has already put in appearance on 02.07.2023. In view of the above, this petition stands disposed of with a direction to the court concerned to conclude and decide the aforesaid application strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of three months positively from the date of production of certified copy of this order. 2. Instructions are available on record, according to which the proceedings are to be decided on 29.09.2026, as is apparent from the instructions dated 23.09.2026 furnished by the learned Judicial Magistrate. 3. In view of the aforesaid development, the present contempt application has outlived its utility and purpose. Accordingly, the contempt application is consigned to the record, leaving it open to the applicant to question the same before the appropriate forum, in accordance with law. 4.
