Case No.106 of 2026 dated 03.03.2026 under Section 126(2)/117(2)/118(2)/109/303(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of: Pritam Bakuli & Ors. ….Petitioners. Mr. Anindya Ghosh Mr. Pronojit Roy …for the petitioners. Mr. Debabrata Chatterjee Ms. Sana Naaz ….for the State. Learned counsel appearing on behalf of the petitioners submits as follows. There was an altercation over playing loud music. However, the present petitioners have been falsely implicated in this case. Three other co-accused were arrested and were thereafter granted bail. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. She refers to the statements of the victims and other witnesses. She also relies on the injury reports of the two victims, showing lacerated wounds over the left cheek and the vortex of the head as well as the bite marks and the like. It appears that one of the victims has specifically named Sanjay Bakuli, Suvendu Bakuli, Nabin Bakuli along with unnamed others, as the assailants in the injury report and the other victim has specifically named Sanjay Bakuli, Suvendu Bakulli and Nabin Bakuli and unnamed others as the assailants. 2 Considering the above and the alleged roles ascribed to each of the accused, although I am inclined to grant anticipatory bail to the petitioners, the movement of some of the petitioners shall remain restricted for a limited period. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further condition that the petitioners shall cooperate with investigation, shall not threaten or intimidate witnesses, the petitioner nos. 1 and 4 shall meet the I.O. once a week till submission of report in final form and shall stay outside the jurisdiction of Uluberia P.S. for a period of four months except for attending the jurisdictional Court or meeting the Investigating Officer or casting their vote in the ensuing Assembly Elections. The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
