Mr. Amitesh Chakraborty …for the petitioners The petitioners herein is aggrieved with the order dated 15.01.2026, by which the Court below had issued warrant of arrest against the petitioners, as the petitioners were found absent on call. Learned Counsel for the petitioners submits that they may be given liberty to surrender before the Court below. Since the prayer made by the petitioners is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice, service of copy of application upon the opposite party is dispensed with. Having heard learned Counsel for the petitioners, the instant application being CRR 1820 of 2026 is hereby disposed of by giving liberty to the petitioners to surrender before the Court below within two weeks from this date. In the event of such surrender, the Court below will dispose of his prayer in accordance with law without being influenced by any observation made herein. The impugned order dated 15.01.2026 by which the warrant of arrest was issued against the petitioners are hereby stayed for a period of 2 two weeks or till the petitioners surrender before the Court below, whichever is earlier.
