Heard Mr. M.H. Ahmed, learned counsel appearing for the accused-applicant. Also heard Mr. R.R. Kaushik, learned Addl. P.P., representing the State respondent. This is an application filed under Section 483 of the BNSS, 2023, praying for granting bail to the accused-applicant in connection with Bihpuria P.S. Case No.
Page No.# 2/3 117/2026, registered under Sections 179/180 of BNS, 2023. An FIR was lodged on 03.07.2026 by one Sub-Inspector (UB) Satra Sing Pator of Bongalmara Outpost, before the Officer-in-Charge, Sonapur Police Station, alleging, inter alia, that on 03.07.2026 at about 4:10 PM, the police received reliable information that one Pulsar 220 motorcycle bearing Registration No. AS-07-V- 8414, driven by Ainul Hoque, was coming from Pavha Chariali to Sonapur Center under Bongalmara Outpost, carrying fake Indian currency notes. On receipt of such information, police went to Sonapur Center, wherein after seeing the police, the accused person fled the spot leaving the motorcycle there. Upon investigation and search of the motorcycle, police recovered fake Indian currency notes amounting to Rs. 3 lakhs. It is alleged that during investigation, it has come to the knowledge of the police that the accused-applicant has been carrying out business of fake currency notes involving many peoples. On receipt of the FIR, police registered Bihpuria P.S. Case No. 117/2026, under the aforementioned sections. This is a second application filed by the accused-applicant, praying for bail after the first bail application, i.e., Bail Application No. 2135/2026, was rejected on 19.08.2026, i.e., after 9 days of such rejection. The earlier bail application was rejected on due consideration of submissions made by learned counsel appearing for the respective parties as well as on perusal of the Case Diary. This present bail application has been filed without any new grounds or without any new pleadings, except the contention that the wife of the accused- applicant is suffering from some illness.
On perusal of the document that has been submitted to show that the accused-applicant's wife is suffering from some illness, it is seen that there is no signature of the medical practitioner in the document. Page No.# 3/3 Taking into account the entire facts of the case and finding no ground to release the accused-applicant at this stage, the instant bail application stands rejected.
