Dated 07.10.2026
The Court made the following:
ORDER:
The Criminal Revision Case has been filed challenging the order dated 10.01.2019 passed in Crl.M.P.No.528 of 2016 in S.R.No.1131 of 2016 on the file of the learned II Additional Judicial I Class Magistrate, Bhimavaram, whereby and whereunder an application filed under Section 142(B) of the Negotiable Instruments Act, seeking to condone the delay of 231 days in re- presenting the complaint, was dismissed.
2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor.
3. In spite of granting several opportunities to serve notice on Respondent Nos.1 and 2, the Petitioner has failed to serve notice on them. Without hearing the other side, no orders can be passed in this Criminal Revision Case.
4. At the expense of the Government or the High Court, notice on Respondent Nos.1 and 2 cannot be ordered. It is the Petitioner who has to pay the process fee for the Respondents, as the case is a complaint case. No doubt, a Criminal Revision Case cannot be dismissed for default or non- prosecution, but here is a case where the Petitioner has not paid the process fee. Hence, the Criminal Revision Case is liable to be dismissed for non- payment of process fee in respect of Respondent Nos.1 and 2.
5. Accordingly, the Criminal Revision Case is dismissed. There shall be no
order as to costs.
