This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.79/2026 registered at Police Station - Dongargarh District - Rajnandgaon (C.G.) for the offence punishable under Section 303(2) of Bharatiya Nyaya Sanhita, 2023 (BNS). 2. The prosecution story, in brief, is that on 13.02.2026 the complainant namely Ramesh Kumar Agrawal lodged a written report VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.04.21 11:13:09 +0530 2 at Police Station Dongargarh with the averment that he owns a farmhouse situated at village Bhandarpur (Rajkatta). That, on 13.02.2026, when the complainant visited his farmhouse, he found that several agricultural and other valuable items were missing, including, Submersible pump with iron pipe 400 feet, Cable wire 500 feet, Starter Sprinkler pipes 110 units, Babool tree 1 piece, and other trees 25 piece, Petrol- operated spray pump with pipe 200 meters, Agricultural tools like axe, crowbar, etc. Gunny bags 600 units, Total be around value of stolen property is alleged to Rs.2,00,000/- and the complainant alleged that the present applicant Mahendra Suryavanshi, who was as a caretaker of the said farmhouse, employed committed theft of the aforesaid articles without permission. On the basis of the said complaint FIR registered against the applicant. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has falsely been implicated in this case. It is submitted that father of the applicant who has been cultivating the complainant’s land on lease basis for the last year. He also submits that after harvesting, 218 quintals of paddy was produced and sold in the concern society, and the entire sold amount Rs.5,66,800/- was directly credited into the complainant’s bank account. When the applicant’s father demanded amount from the complainant after adjustment of lease dues, the complainant avoid payment and lodged false report. He also submits that applicant has no criminal antecedent, therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposed the bail application and submits that applicant has no criminal antecedent. 3 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation leveled against the applicant, further considering the fact that applicant has no previous criminal antecedent at this stage without expressing any opinion on merits, this Court is of the view that the applicant is entitled to be granted anticipatory bail. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant Mahendra Surywanshi on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
