1. Instant bail application has been filed by petitioner under Section 483 BNSS in connection with FIR No.33/2025 registered at Police Station Moti Dungri, District Jaipur City (East) for offence under Sections 314, 316(2), 318(2) & 323 of BNS. Subsequently, charge-sheet has been submitted for offences under Sections 316(2), 318(2), 318(4), 336(3), 338, 340(2), 61(2) of BNS. 2. It has been submitted by counsel for petitioner that allegation against the petitioner is to draw a bank loan of Rs.14.50 lakhs in connivance with the bank employees, disclosing himself to be a government employee; after investigation, charge-sheet has been filed and in the previous criminal cases, petitioner has been stated to be acquitted; petitioner is in custody since 26.03.2026 and

Heard counsel for petitioner as well as learned Public Prosecutor and perused the material available on record. 4. Taking into consideration facts and circumstances of the present case and the fact that allegation against the petitioner is to draw a bank loan of Rs.14.50 lakhs in connivance with the bank employees, disclosing himself to be a government employee; after investigation, charge-sheet has been filed and in the previous criminal cases, petitioner has been stated to be acquitted; petitioner is in custody since 26.03.2026 and conclusion of trial will take a considerable time, but without commenting on merits of the case, this Court deems it just and proper to release the petitioner on bail. 5.

Accordingly, the bail application is allowed and it is ordered that the accused-petitioner Sunil Kumar Beniwal S/o Gulab Chand Beniwal, shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
