02/ 11.05.2026: Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioner are apprehending their arrest in connection with Deoghar Town P.S. Case No. 92 of 2026, registered under sections 126(2), 115(2), 351(4), 352, 303(2), 109(1) and 3(5) of BNS, 2023, pending in the Court of learned Chief Judicial Magistrate, Deoghar.

Learned counsel for the petitioners submits that at the spur of moment due to parking of the motorcycle altercation took place between the petitioners and informant. He next submits that petitioners have got no criminal antecedent which is disclosed in para 15 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations of assault are there.

From the contents of F.I.R, it transpires that due to parking of the motorcycle altercation took place between the petitioners and informant and that has occurred at the spur of moment. The petitioners have got no

criminal antecedent which is disclosed in para 15 of the petition.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand)each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Deoghar, in connection with Deoghar Town P.S. Case No. 92 of 2026, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
