Also heard Mr. B. Sarma, learned Additional Public Prosecutor appearing for the State of Assam. By this application, the petitioner seeks the privilege of bail in connection with Dibrugarh P.S. Case No. 40/2026 registered under Section 316(5) of the Page No.# 2/2 BNS, 2023. The First Information Report, in connection with which the petitioner is apprehending arrest was lodged on 12.02.2026 by the Inspector of Posts, Dibrugarh Sub-Division stating inter alia that an amount of Rs.15,28,596/- had been misappropriated from the Mohanaghat Sub Post Office. The name of the petitioner finds mention in the said FIR who was then working as the Sub- Postmaster of Tengakhat Sub Post Office. It is seen that the petitioner was enlarged on pre-arrest bail vide order dated 13.08.2026 subject to the condition that she shall appear before the Investigating Officer (IO) within seven days from the date of the said order and that her statement shall be recorded. Mr. B. Sarma, learned Additional Public Prosecutor submits that the petitioner has appeared before the Investigating Officer and her statement has been recorded. Thus, it is evident that the petitioner has cooperated with the investigation. In view of the same, this Court deems it appropriate to make the order dated 13.08.2026 absolute, subject to the further condition that the petitioner shall strictly comply with all the conditions stipulated in the said order.
