JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioner seeks the following reliefs: “a. A Writ in the nature of Certiorari quashing the order dated 12.02.2026 passed by the II Add. Civil Judge, Bengaluru Rural, on I.A.No.2 in O.S.No.160/2025 at Annexure- 'L', by allowing the present Writ Petition and consequently, allow I.A.No.2 filed by the Petitioner in O.S.No.160/2025; b. Grant costs; C. Grant such other relief/s as this Hon'ble Court deems fit to grant in the circumstances of the case and in the interest of justice and equity.” - 3 - HC-KAR NC: 2026:KHC:11987 WP No. 5656 of 2026 2. Heard learned counsel for the petitioner and learned counsel for the respondents and perused the material on record. 3. A perusal of the material on record will indicate that the suit in O.S.No.160/2025 out of which the present petition arises, currently stands posted before the Trial Court on 09.06.2026. It is also a matter of record and an undisputed fact that the respondent- BDA, who has entered caveat in the present petition, is contesting the said suit as well as the application for temporary injunction filed by the petitioner-plaintiff on merits. 4. Under these circumstances, though several contentions have been urged by both sides in support of their respective claims, without expressing any opinion on the merits/demerits of the rival contentions, I deem it just and appropriate to dispose of this petition by issuing certain directions to the Trial Court as well as to the parties. 5. In the result, I pass the following: ORDER (i) The petition is hereby disposed of. - 4 - HC-KAR NC: 2026:KHC:11987 WP No. 5656 of 2026 (ii) The Trial Court is directed to prepone/advance the suit from 09.06.2026 to 04.03.2026. (iii) On 04.03.2026, the respondents-defendants shall enter appearance, if not already entered, as on today and file written statement, objections, documents etc. (iv) Immediately upon the respondents-defendants entering appearance and filing written statement, objections, documents etc., the Trial Court shall consider and pass appropriate orders on I.A.No.2 for temporary injunction filed by the petitioner-plaintiff against the respondents- defendants within a period of two weeks from 04.03.2026. (v) It is further directed that without prejudice to the respective contentions urged by both sides, both parties shall maintain status quo in all respects, as on today, in relation to the suit schedule property, till disposal of I.A.No.2 by the Trial Court on merits and in accordance with law. - 5 - HC-KAR NC: 2026:KHC:11987 WP No. 5656 of 2026 (vi) The Trial Court shall pass appropriate orders on I.A.No.2 without being influenced by either the order of status quo or by any findings, observations, etc., if any in the present order. (vii) All rival contentions on all aspects of the matter are kept/left open and no opinion is expressed on merits/demerits of the rival contentions.
