JUSTICE GIRISH KATHPALIA O R D E R % 28.01.2026 1. The accused/applicant seeks regular bail in case FIR No.45/2025 of PS Crime Branch for offence under Section 21/25/29 NDPS Act. 2. Broadly speaking, the allegation against the accused/applicant is that on the basis of his disclosure statement, he led the police party to the house of co-accused Sonia, from where he got recovered 14 gm MDMA. The threshold of commercial quantity is 10 gm MDMA. 3. Learned counsel for accused/applicant submits that co-accused Sonia has already been granted bail by the Court of Sessions. It is contended that the MDMA was planted on the accused/applicant. 4. It is not disputed that co-accused Sonia is paternal Aunt of the accused/applicant. According to prosecution, the house from where MDMA was recovered is infact the store house. This is a digitally signed order. Further, the IO/SI Satwant Singh has also played in the Court an audio clip, which is a voice note that had been sent by the accused/applicant to co-accused Sachin. It is co-accused Sachin, whose disclosure led to the present accused/applicant. Learned counsel for accused/applicant submits that voice sample of the accused/applicant has not been taken till date for forensic analysis. On the other hand, learned prosecutor submits that they are in the process of collecting the voice sample of the accused/applicant as investigation is pending. 6. At this stage, learned counsel for accused/applicant, on instructions, seeks permission to withdraw this bail application with liberty to file afresh at appropriate stage. 7.
