Since common questions of law and facts arise in all these writ petitions, they were heard analogously and are being decided by this common judgment. The principal grievance raised by the petitioners is against the freezing/debit-freezing/lien marking over their bank accounts pursuant to communications issued by the Investigating Agencies in connection with alleged cyber financial frauds. The petitioners seek defreezing of their respective bank accounts and restoration of their right to operate the same. Having regard to the large number of similar matters coming before this Court and the recurring nature of the grievance, this Court considers it appropriate not merely to examine the individual grievances, but also to lay down certain general directions and safeguards so that the legitimate interests of investigation and recovery of cyber-fraud proceeds are protected without subjecting innocent citizens, firms, companies and other account holders to arbitrary or disproportionate financial restrictions. Broadly stated, however, the petitioners are individuals, proprietorship concerns, partnership firms, companies and other account holders whose bank accounts have either been completely frozen, debit-frozen or subjected to a lien pursuant to information allegedly received from investigating agencies regarding one or more transactions suspected to have a connection with cyber financial fraud. In some matters, the disputed transaction is of a very small amount, sometimes less than Rs.100/-, Rs.1,000/-, Rs.5,000/- or Rs.10,000/-, whereas the entire bank account containing substantially larger amounts has been rendered inoperative. In certain cases, the amount allegedly connected with the offence itself has not been crystallised. In some cases, the petitioners assert that they are neither accused, nor suspects and there is no material demonstrating their conscious involvement in the alleged cyber fraud. In some matters, investigation has already culminated in a clean chit, closure report or other order exonerating the account holder, yet the bank account continues to remain frozen. 3. Another recurring grievance is that despite there being no FIR, no complaint against the concerned account holder on the National Cybercrime Reporting Portal (‘NCRP’) or any other official platform, the bank account has been frozen merely on the basis of a communication or letter purportedly issued by an Investigating Officer, sometimes without specifying the FIR/crime number, the nature of the offence, the disputed transaction, the amount [2026:RJ-JP:33344] (53 of 77) [CW-2679/2026] allegedly involved or the statutory provision under which the restraint has been imposed. There are also cases where a bank, on receiving information regarding a suspicious transaction, has independently placed restrictions upon the account on account of suspected mule-account activity, unusual transactions or deficiencies in KYC/source-of-funds/ income documentation. Such cases require to be separately dealt with in accordance with the banking and regulatory framework, and cannot mechanically be equated with a police-directed restraint. 4. The grievance is not confined to the initial freezing of accounts. A substantial number of petitioners have stated that even after approaching the concerned bank and/or Investigating Agency, they have not been informed of the precise reason for the restraint, the amount allegedly involved, the transaction ID/UTR concerned, the case in which the amount is required, or the authority under which the restraint continues. In several cases, representations remain unattended for considerable periods. This Court is also informed that the Ministry of Home Affairs, Government of India, through the Indian Cybercrime Coordination Centre (I4C), issued on 02.01.2026 a comprehensive Standard Operating Procedure for the National Cybercrime Reporting Portal (NCRP) and Citizen Financial Cyber Fraud Reporting and Management System (CFCFRMS), dealing, inter alia, with putting amounts on hold, suspension of digital banking services, seizure of accounts, restoration of money and grievance redressal. The Central Government has subsequently stated that the Grievance Redressal Module and Money Restoration Module have been made functional from April 2026. [2026:RJ-JP:33344] (54 of 77) [CW-2679/2026] 5. Learned counsel appearing for the petitioners, in substance, submitted that freezing of the entire bank account is arbitrary, excessive and disproportionate. It was argued that a bank account in the present economic and technological environment is an essential instrument for receiving salary and business receipts, making payments, meeting statutory liabilities, paying employees and vendors and maintaining day-to-day livelihood. According to learned counsel, mere existence of a suspected transaction cannot justify depriving an account holder of access to his entire lawful balance. Even assuming that a particular credit is suspected to represent proceeds of cyber fraud, the restraint, ought ordinarily to be confined to the identifiable disputed amount. 6. Learned counsel further submitted that the petitioners cannot be made to suffer merely because a small amount has passed through their accounts in the course of an extensive money trail. Unless the investigation discloses a prima facie nexus between the account holder and the alleged offence, continuation of a blanket debit freeze amounts to imposing punishment without trial. It was also submitted that where the account holder has been exonerated, where the investigation has concluded, where no FIR or NCRP complaint exists against him, or where the Investigating Agency itself has not crystallised the disputed amount, continued freezing of the entire account has no rational nexus with the object of investigation. 7. It was further argued that the Central Government SOP dated 02.01.2026 itself provides a mechanism for grievance redressal and removal of holds/lien and, therefore, the [2026:RJ-JP:33344] (55 of 77) [CW-2679/2026] investigating agencies and banks are required to act in accordance with the said mechanism within the prescribed time. Learned counsel submitted that failure to act upon the grievance mechanism cannot result in an indefinite deprivation of the account holder's property and livelihood. 8. Per contra, learned counsel appearing for the State and investigating agencies submitted that cyber financial crimes are fundamentally different from ordinary offences because the money is transferred rapidly through several layers and may disappear from the financial system before the investigation can trace it. It was contended that immediate freezing or holding of an account is therefore an important investigative measure. In some matters, the account holders have been identified as Layer-1 recipients and the transaction trail directly connects their accounts with the reported cyber fraud. It was argued that, at the stage of investigation, the Investigating Officer is not required to conclusively establish guilt and only a reasonable basis for suspicion is necessary. 9. It was further submitted that the action of the investigating agency is intended to preserve the suspected proceeds of crime and is not punitive. Learned counsel submitted that if the entire account is allowed to remain operational during investigation, there is a real possibility of misusing or withdrawal of the suspected amount. It was accordingly urged that this Court should not interfere with legitimate investigative measures merely because the account holder claims financial hardship. 10. Learned counsel appearing for the banks submitted that banks ordinarily act upon lawful instructions received from [2026:RJ-JP:33344] (56 of 77) [CW-2679/2026] competent investigating agencies and are also required to comply with their independent obligations under the applicable banking, KYC, anti-money-laundering and fraud-risk-management framework. It was submitted that where an account exhibits unusual transaction patterns or deficiencies in KYC/source-of- funds or income documentation, appropriate restrictions may be imposed by the bank independently of any criminal investigation. The banks, however, have no objection to operating the accounts in accordance with lawful and reasoned directions issued by the competent authority. 11. This Court has carefully considered the rival submissions, examined the material placed on record and also considered the statutory framework, the constitutional principles governing State action and the recent judicial developments concerning freezing of bank accounts in cyber-crime investigations. 12. There can be no quarrel with the proposition that prevention and investigation of cyber financial crimes constitute matters of considerable public importance. The State has not only the power, but also the duty to protect victims of cyber fraud, prevent dispersion of the proceeds of crime and ensure that unlawfully diverted funds remain traceable and recoverable. The CFCFRMS has been established precisely with the object of enabling immediate action in financial cyber fraud cases and the Central Government has reported that substantial amounts have been saved through the system. 13. Equally, however, the existence of a legitimate investigative power does not mean that its exercise is immune [2026:RJ-JP:33344] (57 of 77) [CW-2679/2026] from constitutional scrutiny. Every exercise of statutory power by a public authority is subject to the requirements of legality, rationality, reasonableness, non-arbitrariness and proportionality. The seriousness of cyber-crime cannot justify abandoning the safeguards which protect an innocent citizen against arbitrary State action. 14. A bank account is undoubtedly “property” in the legal sense. More importantly, in contemporary life it is not merely a repository of money. It is the principal mechanism through which an individual receives his salary or business receipts, pays for food, education, medical needs, rent, taxes and utilities, discharges contractual obligations and carries on trade or profession. In the case of a business entity, complete freezing of the account may prevent payment of employees, statutory dues, suppliers and creditors and may effectively paralyse the business. The civil consequences of such action can therefore be immediate, grave and disproportionate. 15. Section 106 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter to be referred as ‘the BNSS’) corresponds substantially to the former Section 102 of the Code of Criminal Procedure, 1973 (hereinafter to be referred as ‘Cr.P.C.’) and empowers a police officer to seize property which may be alleged or suspected to have been stolen or which is found under circumstances creating suspicion of the commission of an offence. Significantly, sub-section (3) requires the police officer acting under the provision to forthwith report the seizure to the Magistrate having jurisdiction. [2026:RJ-JP:33344] (58 of 77) [CW-2679/2026] 16. The BNSS has, however, introduced a significant and specific provision in Section 107 dealing with attachment, forfeiture or restoration of property derived or obtained, directly or indirectly, as a result of criminal activity or the commission of an offence. Section 107 of the BNSS contemplates for filing of an application by the Investigating Officer, with the approval of the Superintendent of Police or Commissioner of Police, to the competent Court or Magistrate; where the Magistrate is thereafter required to apply his judicial mind and, ordinarily, issue notice and provide an opportunity of hearing before attachment. In an emergent case, an interim ex parte order may be passed where notice would defeat the object of attachment. 17. The distinction between seizure for purposes of investigation and attachment for securing proceeds of crime is therefore material. The former is an investigative measure accompanied by the statutory obligation of reporting to the Magistrate; the latter involves judicial supervision and the safeguards expressly incorporated in Section 107 of the BNSS. The Investigating Agency cannot be permitted to achieve, by merely labelling its communication as a “freeze”, “debit freeze”, “lien” or “seizure”, a result which in substance amounts to indefinite attachment of the property of a citizen without following the procedure prescribed by law. 18. This aspect assumes greater significance because several High Courts have recently examined the problem of indiscriminate freezing of bank accounts in cyber-crime cases. In Neelkanth Pharma Logistics Pvt. Ltd. vs. Union of India & Another, 2025 SCC OnLine Del 1055, the Delhi High Court [2026:RJ-JP:33344] (59 of 77) [CW-2679/2026] noticed that the petitioner's account containing a substantial balance had been frozen because of a credit of only Rs.200/-. The Court observed that where the disputed amount is identifiable, marking a lien upon that amount should ordinarily be explored as the appropriate interim measure rather than freezing the entire account. The Delhi High Court also emphasised that blanket freezing has serious consequences for the right to livelihood and directed that reasons must be furnished when the entire account is sought to be frozen. 19. The principle of proportionality emerging from the aforesaid decision commends acceptance. The investigative agency must certainly be permitted to secure the suspected amount; but the protection of the victim cannot automatically translate into punishment of an account holder who has not yet been found guilty, particularly where the latter's account contains funds having no demonstrated connection with the alleged offence. 20. This Court, in its earlier decision dated 30.06.2026 delivered in the case of Jinat Bano vs State Bank of India & Another (S. B. Civil Writ Petition No. 5036/2026), in the circumstances where small disputed amount despite being identifiable, entire account was arbitrarily frozen by the Bank Authorities on an intimation received from the Investigation agency, after applying doctrine of proportionality, has given following directions: “13. Accordingly, while balancing the requirements of a fair investigation with the petitioner's right to access and operate her legitimate funds, the present writ petition is disposed of with the following directions: (i) Respondent-bank shall forthwith remove the debit freeze/restriction imposed upon the bank account in [2026:RJ-JP:33344] (60 of 77) [CW-2679/2026] question and permit the petitioner to operate the bank account in question in the ordinary course. (ii) Respondent-bank shall, however, continue to maintain a lien or restraint only to the extent of the amount in question, which is alleged to be connected with the transaction under investigation and the petitioner shall not be entitled to withdraw, transfer or otherwise deal with the amount in question without permission of the competent authority. (iii) The petitioner shall extend full cooperation to the investigating agency and appear before the concerned authorities as and when called upon to do so for the purpose of investigation. (iv) The petitioner shall maintain the bank account in question in active status and shall not close, surrender or otherwise discontinue the same without prior intimation to and permission from the investigating agency till conclusion of the investigation. (v) It is clarified that the present order shall not be construed as an expression on the merits of the allegations under investigation. The investigating agency shall remain at liberty to proceed in accordance with law and take such action as may be warranted on the basis of material collected during investigation. (vi) In the event, the investigation ultimately reveals the petitioner's involvement in the alleged offence or establishes that the amount in question constitutes proceeds of the unlawful transaction, it shall be open for the competent authority to deal with the amount in question and take consequential action strictly in accordance with law. (vii) It shall further be open to Respondent-bank and the investigating agency to deal with or transfer the amount in question in accordance with any lawful direction issued by the competent authority having jurisdiction in the matter.” 21. This Court finds that the aforesaid directions in the given case were sufficient and effective, but are not exhaustive enough to cover other grievances, as raised by number of petitioners in the present batch of writ petitions. 22. It would not be out of place to mention that the SOP dated 02.01.2026 was framed to establish a fair and transparent uniform process for all participating entities and specifically provides mechanisms for putting amounts on hold, seizure of accounts, restoration of money and time-bound grievance redressal. [2026:RJ-JP:33344] (61 of 77) [CW-2679/2026] 23. The SOP is of particular significance in the present context. It represents an institutional response to the very problem which has come before this Court in these writ petitions. It does not proceed on the premise that every account through which a suspected transaction has passed must be rendered completely inoperative. Rather, it contemplates transaction-linked action, accountability of participating entities and a structured grievance redressal process. The Central Government itself has described the SOP as providing a uniform framework for complaint processing, bank coordination, grievance redressal, removal of lien markings and restoration of defrauded funds. 24. Clause 10.1 of the SOP is particularly relevant. It contemplates that an affected account holder may approach the bank, whereupon the bank is required to undertake Customer Due Diligence and Enhanced Due Diligence and, where justified, submit the grievance through the CFCFRMS Grievance Redressal Module. The SOP contemplates submission by the bank at the earliest and not beyond seven calendar days from the grievance. The grievance is thereafter assigned to the concerned Investigating Officer/police officer for verification. 25. The Court is, however, of the considered opinion that the existence of the CFCFRMS mechanism cannot be treated as an alternative to constitutional fairness; rather, it is a mechanism intended to operationalise fairness and accountability within the investigation process. Failure of an officer or bank to act within the prescribed framework cannot become a justification for continuing an indefinite freeze. [2026:RJ-JP:33344] (62 of 77) [CW-2679/2026] 26. At the same time, this Court cannot accept the broad proposition that every freeze is illegal merely because the account holder is not named as an accused in the FIR. Cyber financial frauds necessarily involve layers of transactions and an innocent intermediary account may sometimes receive proceeds without the account holder's knowledge. Conversely, the absence of an FIR against a particular person cannot by itself preclude legitimate preliminary verification or urgent preservation of a suspected amount. The decisive consideration must be whether there exists objective material demonstrating a reasonable and proximate nexus between the account/transaction and the alleged offence and whether the extent and duration of restraint are reasonably necessary. 27. Thus, four requirements must ordinarily govern the exercise of power: first, there must be lawful authority for the restraint; second, there must be tangible material disclosing a prima facie nexus between the particular account or transaction and the offence under investigation; third, the Investigating Officer must identify, as far as reasonably practicable, the transaction and amount requiring protection; and fourth, the restraint must be proportionate to the investigative necessity and cannot continue mechanically after the necessity ceases to exist. 28. A mere expression such as “suspicious transaction”, “mule account”, “Layer-1 account” or “cyber fraud transaction” cannot, by itself, constitute adequate reasons for indefinitely immobilising the entire bank account. Such expressions may justify investigation, but they cannot substitute the material upon which the conclusion of suspicion is founded. The communication [2026:RJ-JP:33344] (63 of 77) [CW-2679/2026] to the bank should, subject to legitimate investigative confidentiality, contain sufficient particulars to enable the bank to identify the account and transaction concerned and to understand the nature and extent of the restraint. 29. The Court is particularly concerned by instances where the alleged disputed amount is very small while the entire account is frozen. If, for example, the alleged cyber-fraud amount is Rs.500/- but the account contains Rs.5 lakhs, the object of investigation is ordinarily achieved by preserving Rs.500/- and not by depriving the account holder of the remaining Rs.4,99,500/-. 30. The same principle applies where the alleged amount has not yet been crystallised. An Investigating Officer cannot indefinitely communicate to a bank that the “account is under investigation” and thereby cause a complete freeze for an unspecified period. Investigation may be continuing, but the financial restraint must nevertheless remain connected to a legally permissible investigative purpose. Where immediate preservation is necessary, the officer must take appropriate steps under the applicable statutory provisions and seek judicial orders wherever the law so requires. 31. There is also a fundamental distinction between holding a disputed amount and freezing an entire account. The former preserves the subject matter of the alleged offence while permitting legitimate funds to remain available to the account holder; the latter disables the entire financial life of the person. Proportionality consequently requires that, wherever the disputed amount is identifiable and there is no specific material demonstrating wider complicity, the first course should ordinarily [2026:RJ-JP:33344] (64 of 77) [CW-2679/2026] be to place a lien/hold upon the disputed amount rather than debit-freeze the entire account. 32. A blanket freeze may nevertheless be justified in exceptional cases. Such cases may include, illustratively, where the account itself appears to be a deliberately operated mule account; where there are repeated suspicious credits and onward transfers; where the account holder is a named accused or there is material showing conscious participation; where the entire balance is reasonably suspected to constitute proceeds of crime; where multiple linked transactions make segregation presently impracticable; or where partial operation of the account would demonstrably defeat the investigation. Even in such cases, the reasons for adopting the more restrictive measure must be recorded in writing and should be periodically reviewed. 33. This Court also finds substance in the grievance that in certain cases the bank has received a communication which does not specify whether the action is being taken pursuant to an FIR, NCRP/CFCFRMS report, statutory seizure, judicial order or independent banking/KYC action. Such ambiguity is impermissible. An account holder cannot be left unaware of the authority or nature of the restraint affecting his property. 34. Accordingly, it is directed that every communication issued by a police/investigating agency to a bank for freezing, debit-freezing, lien marking, holding or seizure of a bank account shall, to the extent permissible without prejudicing the investigation, clearly indicate: (i) the name and designation of the Investigating Officer; (ii) the police station/agency and contact particulars; (iii) FIR/crime/NCRP/CFCFRMS reference number, [2026:RJ-JP:33344] (65 of 77) [CW-2679/2026] wherever available; (iv) the legal provision under which action is taken; (v) the account number and bank details; (vi) the transaction ID/UTR/date of the transaction, wherever available; (vii) the disputed amount or the basis for concluding that the entire account requires restraint; and (viii) whether the communication is intended as a hold/lien on a specified amount, suspension of digital banking facilities, seizure of the account or a request for judicial attachment. 35. Where the bank receives a communication which merely mentions a suspected transaction without identifying the disputed amount, the bank should, through its designated nodal officer, seek clarification from the requisitioning authority rather than mechanically converting a transaction-specific alert into an indefinite blanket freeze, unless the communication expressly and lawfully requires wider restraint and contains reasons supporting such action. 36. The requirement of reporting under Section 106(3) of the BNSS is mandatory. Therefore, where the police action constitutes seizure of property under Section 106 of the BNSS, the Investigating Officer shall forthwith report the seizure to the competent Magistrate. A bank cannot be used as a substitute for the statutory judicial process. Where the restraint is in substance an attachment of property as proceeds of crime, the Investigating Officer shall invoke Section 107 of the BNSS and obtain the appropriate order of the competent Court/Magistrate in accordance with law. 37. This Court makes it clear that the aforesaid directions do not prevent the investigating agency from taking immediate [2026:RJ-JP:33344] (66 of 77) [CW-2679/2026] action in an emergent situation to prevent dissipation of suspected proceeds of cyber fraud. The investigating agency may take such action as is permissible in law and under the CFCFRMS/SOP. What is prohibited is the conversion of an urgent, temporary investigative measure into an indefinite and disproportionate deprivation without subsequent application of mind and compliance with the statutory safeguards. 38. Another category requiring special attention is that of persons who have been exonerated, discharged, or in whose cases investigation has culminated without finding their involvement. Once the investigating agency has no further requirement to preserve the amount or account, there is no justification for continuing the restraint. A citizen cannot be required to repeatedly approach different authorities merely to obtain restoration of a right which the investigating agency itself no longer needs to restrict. 39. Accordingly, it is directed that whenever an investigation is concluded, a closure report is filed, the account holder is exonerated, or the Investigating Officer otherwise forms an opinion that continuation of the freeze/lien is not necessary, the concerned Investigating Officer shall forthwith communicate the decision to the bank and update the relevant CFCFRMS/NCRP record, wherever applicable. The bank shall thereafter remove the police-directed restraint expeditiously, of course, subject to any independent statutory restraint lawfully existing for reasons unrelated to the concluded investigation. 40. This Court is also conscious of the cases where the bank itself has noticed unusual transactions, failure to comply with [2026:RJ-JP:33344] (67 of 77) [CW-2679/2026] KYC requirements, suspicious identity, unexplained source of funds or characteristics suggesting use of the account as a mule account. Nothing contained in this judgment shall be construed as disabling a bank from taking action independently required under the applicable RBI directions, KYC norms, anti-money-laundering framework or other law. However, such action must be clearly distinguished from a police-directed cyber-crime freeze. The bank shall communicate to the customer the nature of the restriction and the steps required for rectification, subject to restrictions on disclosure imposed by law. 41. This Court also considers it necessary to deal with cases where there is no FIR or NCRP/CFCFRMS complaint against the account holder. As already observed, absence of an FIR against a person does not by itself render every preliminary investigative measure illegal. Nevertheless, an unverified or vague communication cannot be the sole basis for indefinitely freezing a citizen's entire bank account. Where the communication is not supported by an identifiable investigation, complaint, transaction or material showing a prima facie nexus with an offence, the restraint cannot be permitted to continue merely because the bank has received a letter from an unidentified or unauthorised source. 42. The grievance mechanism prescribed under Clause 10 of the SOP must be made effective in practice. An account holder, who approaches the bank with a bona fide grievance, cannot be relegated from the bank to the police and from the police to another State agency indefinitely. The very object of a centralised grievance mechanism is to ensure that responsibility is fixed upon [2026:RJ-JP:33344] (68 of 77) [CW-2679/2026] the concerned participant and that the grievance is resolved within a reasonable and prescribed time. The SOP itself contemplates a seven-day period for the bank to submit the grievance through the CFCFRMS mechanism after receipt of the customer's complaint, and subsequent verification by the concerned Investigating Officer. 43. It is, therefore, directed that the respondents shall scrupulously follow the SOP dated 02.01.2026, as amended or supplemented from time to time by the competent authority. Where the SOP provides a particular procedure or time limit, the same shall be treated as binding upon the concerned participating entity, unless a competent Court has passed an order to the contrary. 44. The Court is of the considered view that the recurring nature of these cases warrants institutional directions. The object is not to create an additional hurdle for cyber-crime investigation, but to ensure that effective investigation and protection of innocent citizens operate simultaneously. The fight against cyber- crime will be strengthened, rather than weakened, when investigating agencies distinguish between a genuine mule account and an innocent account into which an isolated transaction has incidentally travelled. 45. The following principles shall, accordingly, govern freezing/lien/hold/seizure of bank accounts in cyber financial crime investigations within the State of Rajasthan: (A) No bank account shall be subjected to an indefinite blanket debit freeze merely on the basis of a vague, unverified or cryptic communication. [2026:RJ-JP:33344] (69 of 77) [CW-2679/2026] (B) Before imposing or continuing a restraint, the Investigating Officer shall ascertain and record the material showing a prima facie nexus between the particular account/transaction and the offence under investigation. (C) Wherever the disputed amount is identifiable, the ordinary course shall be to preserve that amount by lien/hold rather than freeze the entire account, unless reasons exist demonstrating why wider restraint is necessary. Directions given by this court in the case of Jinat Bano (supra) shall be strictly followed. (D) Where the entire account is required to be frozen because of the nature of the suspected offence, repeated transactions, mule- account indicators, conscious involvement of the account holder, or inability to segregate the proceeds, specific reasons for adopting the wider restraint shall be recorded in the case diary/appropriate record and communicated to the bank. (E) Where the action constitutes seizure under Section 106 of the BNSS, the statutory requirement of forthwith reporting the seizure to the competent Magistrate shall be complied with. (F) Where the investigating agency seeks attachment of property as proceeds of crime, the procedure under Section 107 of the BNSS shall be followed and the matter shall be placed before the competent Court/Magistrate in accordance with law. (G) A freeze shall not continue indefinitely merely because investigation is pending. The necessity of continuing the restraint shall be periodically reviewed by the Investigating Officer and supervisory officer. [2026:RJ-JP:33344] (70 of 77) [CW-2679/2026] (H) If the investigation reveals that the account holder has no connection with the offence and the disputed amount is not required to be retained, the restraint shall be withdrawn forthwith. (I) Upon conclusion of investigation, filing of a closure report, exoneration of the account holder, or a finding that the account/amount is no longer required for investigation, necessary instructions for defreezing shall be issued without avoidable delay. (J) Every communication to the bank shall, as far as permissible, contain sufficient particulars to identify the case, account, transaction and amount involved and the legal basis of the action. (K) The bank shall not mechanically transform a transaction- specific request for holding a particular amount into a blanket freeze of the entire account, unless the communication and the material disclosed therein lawfully justify such wider action. (L) Independent banking restrictions arising from “Know Your Customer” (KYC), “Anti-Money Laundering” (AML), “Fraud-Risk Management” or other regulatory obligations shall remain governed by the applicable law and RBI directions; however, the bank shall clearly distinguish such independent action from a police/cyber-crime restraint. (M) The grievance redressal mechanism under Clause 10 of the SOP dated 02.01.2026 shall be strictly followed. Banks and investigating agencies shall ensure that the account holder's grievance is not left unattended merely because the underlying cyber complaint originated in another State. (N) Verification of an account holder's grievance should ordinarily be undertaken through electronic means/video conferencing [2026:RJ-JP:33344] (71 of 77) [CW-2679/2026] wherever practicable. Personal appearance shall not be insisted upon unless genuinely necessary for the investigation and reasons for such necessity are recorded. The SOP itself contemplates such a mode of verification. 46. So far as the individual writ petitions are concerned, the concerned Investigating Officer and the respective respondent bank shall examine each account in the light of the principles and directions recorded herein. Where the disputed amount is identifiable and there is no material justifying a wider freeze, the account shall be permitted to operate subject only to a lien/hold for the disputed amount. Where no disputed amount is identifiable and no specific material justifies continuation of a complete freeze, the restraint shall be reviewed and appropriate action shall be taken in accordance with law. Where the account holder has already been exonerated or the investigation no longer requires retention of the account/funds, necessary defreezing shall be undertaken forthwith. 47. In matters where the restraint has been imposed solely pursuant to an investigation outside the State of Rajasthan, the concerned authorities of Rajasthan Police/bank shall communicate with the requisitioning agency and obtain the necessary clarification rather than requiring the citizen to travel to another State merely to ascertain why his account has been frozen. Inter- State cyber investigation is a reality; inter-State transfer of hardship to an innocent citizen cannot become its necessary consequence. 48. The Director General of Police, Rajasthan and the Inspector General/DIG in charge of Cyber Crime in the State of [2026:RJ-JP:33344] (72 of 77) [CW-2679/2026] Rajasthan shall, within four weeks from the date of receipt of copy of this judgment, issue a comprehensive General Circular/Standing Order incorporating the principles and directions contained herein. The Circular shall be circulated to all Commissioners of Police, Range IGs/DIGs, District Superintendents of Police, Cyber Crime Police Stations, Investigating Officers and other officers dealing with NCRP/CFCFRMS complaints and financial cyber-crime investigations. 49. The said Circular shall specifically direct every Investigating Officer in the State to comply with the statutory provisions of the BNSS, SOP dated 02.01.2026, the applicable RBI/banking directions and the principles laid down in this judgment. The supervisory officers shall ensure that an account is not subjected to a mechanical or disproportionate blanket freeze and that every continuing restraint is periodically reviewed. 50. The Director General of Police, Rajasthan, shall also designate an appropriate Senior Officer at the State level to monitor complaints relating to prolonged or disproportionate freezing of bank accounts in cyber-crime cases and to coordinate with the State Cyber Crime Wing, CFCFRMS and participating banks. The monitoring mechanism shall maintain appropriate data regarding the number of accounts frozen, amounts placed on hold, grievances received, grievances resolved, and cases where complete freezes were converted into transaction-specific liens. 51. The DIG/competent Senior Officer of the Cyber Crime Wing shall, in particular, ensure that the concerned Investigating Officers are sensitised regarding the distinction between: (i) a [2026:RJ-JP:33344] (73 of 77) [CW-2679/2026] suspected transaction; (ii) a transaction-specific hold/lien; (iii) seizure of property under Section 106 of the BNSS; (iv) attachment of proceeds of crime under Section 107 of the BNSS; and (v) independent banking restrictions arising from KYC/AML/fraud-risk considerations. The terminology used in communications to banks shall correspond to the legal nature of the action actually intended. 52. The concerned banks operating within the State of Rajasthan shall also be informed of this judgment and the General Circular and shall designate appropriate Nodal/Grievance Officers for prompt co-ordination with investigating agencies. Nothing herein shall prevent any bank from complying with a valid order passed by a competent Court or from taking independent action mandated by law or RBI directions. 53. This Court is further of the considered view that effective implementation of the aforesaid safeguards would require appropriate sensitisation and training of the officials of the banking institutions, particularly those dealing with cyber-fraud complaints, account freezing, lien marking and CFCFRMS/NCRP- related matters. Accordingly, the Reserve Bank of India is directed to issue an appropriate General Circular/Advisory to all scheduled banks and other regulated banking entities, requiring them to conduct periodical training and sensitisation programmes for their concerned officials in co-ordination with the Cyber Crime Authorities/Cyber Crime Wing of the State. Such training shall, inter alia, acquaint the concerned bank officials with the nature and modus operandi of cyber financial crimes; the circumstances warranting a transaction-specific hold, lien or other appropriate [2026:RJ-JP:33344] (74 of 77) [CW-2679/2026] restriction; the distinction between placing a hold/lien upon a disputed amount and freezing the entire bank account; the statutory and procedural requirements applicable to seizure or attachment of funds; the serious civil and financial consequences of indiscriminate freezing of bank accounts; the applicable provisions of the CFCFRMS/NCRP and the Standard Operating Procedure (SOP) dated 02.01.2026 and the procedure and prescribed timelines for processing and redressing grievances raised by account holders against such restrictions. The training shall also emphasise that bank officials are required to exercise due diligence and communicate with the concerned Investigating Agency wherever the nature or extent of the restraint is unclear, so that an investigative request relating to a particular transaction or amount is not mechanically converted into a blanket debit freeze of the entire account. The Reserve Bank of India shall also require the concerned banks to maintain an appropriate internal mechanism for periodic review of such restraints and for ensuring prompt compliance with lawful directions for removal of lien/freeze upon cessation of the investigative necessity. These directions are intended to ensure that the banking system acts as an effective partner in combating cyber-crime while simultaneously safeguarding innocent account holders from avoidable, arbitrary or disproportionate financial hardship. 54. It is clarified that these directions are not intended to interfere with a bona fide investigation or to require disclosure of sensitive information where such disclosure would prejudice the investigation or is prohibited by law. The object is only to ensure that the extraordinary financial consequences of freezing a [2026:RJ-JP:33344] (75 of 77) [CW-2679/2026] citizen's bank account are imposed on the basis of objective material, under lawful authority, for a legitimate investigative purpose and only to the extent reasonably necessary. 55. In view of the foregoing discussion and directions, all these writ petitions are disposed of with the aforesaid general directions. The concerned respondents-banks and Investigating Officers shall undertake a review of the respective restraints imposed upon the petitioners' bank accounts and take consequential action in accordance with the principles laid down herein and the applicable statutory provisions/SOP. 56. In cases where the only basis for the continued restraint is a transaction-specific cyber complaint and the disputed amount is identifiable, the concerned bank shall, subject to lawful directions of the competent authority/Court, confine the restraint to such disputed amount and permit operation of the remaining undisputed balance. 57. In cases where the concerned Investigating Officer has already concluded that the petitioner's account or funds are not required for investigation, necessary communication for removal of the restraint shall be issued to the bank forthwith. Where the account has been frozen pursuant to the CFCFRMS mechanism, the grievance shall also be processed in accordance with Clause 10 of the SOP without requiring the petitioner to undertake unnecessary proceedings before multiple authorities. 58. The aforesaid directions shall operate as general directions for all similarly situated cases concerning freezing, debit-freezing, lien marking, holding or seizure of bank accounts in cyber financial crime investigations within the State of Rajasthan [2026:RJ-JP:33344] (76 of 77) [CW-2679/2026] and shall not be confined merely to the petitioners before this Court. They shall, however, remain subject to any contrary order passed by a competent Court in an individual case on the basis of its particular facts. 59. The Director General of Police, Rajasthan and the competent Officer of the Cyber Crime Wing as well as Reserve Bank of India shall submit a compliance report before the Registrar General of this Court within eight weeks from today indicating that the Circular has been issued and circulated to all concerned officers. The report shall also indicate the mechanism put in place for supervisory review of prolonged bank-account freezes. 60. This Court is also of the view that faithful compliance with the aforesaid directions would strengthen public confidence in the banking system and digital modes of financial transactions. While effective measures against cyber fraud are essential, protection of bona fide account holders from arbitrary or disproportionate restrictions is equally necessary. A fair, transparent and time-bound mechanism for freezing and defreezing accounts would, therefore, not only safeguard legitimate property rights but also reinforce citizens’ faith in digital transactions and the formal banking system. 61. Registrar (Judicial) is directed to forthwith send copies of this judgment to the Director General of Police, Rajasthan; DIG, Cyber Crimes, Rajasthan and to Regional Office of Reserve Bank of India in Jaipur (Rajasthan) for necessary information and compliance.
