CORAM : ANIL L. PANSARE AND NIVEDITA P. MEHTA, JJ.
SEPTEMBER 29, 2026 The order of which contempt is alleged was passed on 3/10/2020. The contempt petition, however, is filed in the year 2023. 2] The Counsel for respondent nos. 3 and 4 submits that in terms of Section 20 of the Contempt of Courts Act, 1971 (for short, “Act of 1971”), contempt action will have to be initiated within one year from the date on which contempt is alleged, and if the same is not initiated within one year, no Court can take/initiate proceedings under the Act, either on its own motion or otherwise. 3] In the present case, admittedly, the contempt petition is filed beyond one year. That being so, action under the Act of 1971 cannot be initiated. 4] The contempt petition is, accordingly, dismissed.
