1. Civil Application No.6101 of 2026 is preferred for bringing the legal representatives of respondent No.4 on record, condonation of delay in filing the application, and setting aside the abatement.

3. In view thereof, the Civil Application is allowed in terms of prayer clauses (B), (C) and (D). The amendment shall be carried out forthwith.
ORDER IN SECOND APPEAL

Learned counsel for the appellant submits that the dispute has been amicably settled between the parties. He tenders a copy of the compromise application. The same is taken on record and marked as Exhibit “X”. On the basis of the settlement, he seeks leave to withdraw the Second Appeal.
5. Leave granted.
6. The Second Appeal stands disposed of as withdrawn.
7. In view of the disposal of the Second Appeal, Civil Application No.3510 of 2014 also stands disposed of. No order as to costs.
