The petitioner has preferred this writ petition under Article 226 of the Constitution of India, seeking following reliefs:- “1] That, this Hon'ble Court may kindly be pleased to issue writ/writs, order/orders, direction/directions, to take action against the Sarpanch, Gram Panchayat Ganekera BINI PRADEEP Digitally signed by BINI PRADEEP Date: 2026.03.11 10:59:11 +0530 2 i.e. respondent no. 5 for operation unauthorized Animal Market in gram panchayat, in the interest of Justice. 2] That, the respondent no. 5 i.e. Sarpanch, Gram Panchayat Ganekera may kindly be retrained from operation illegal Animal Market and the same may kindly be shutdown with immediate effect, in the interest of Justice. 3] That, this Hon'ble Court may kindly be pleased to grant any other relief, which it deems fit and proper.” 2. Learned Sr. counsel appearing for the petitioner submits that the petitioner has been operating Goat Market under the licence issued by respondent No.4, within the Municipal area of Basna, Mahasamund for the past ten years. The licence issued in favour of the petitioner has been renewed from time to time. He further submits that respondent No.5 has started operating Goat Market within Gram Panchayat Ganekera, Block Basna, Distt. Mahasamund, without getting any licence, agreement or approval from the competent authority under the Prevention of Cruelty to Animals (Regulation of Livestock Market) Rules, 2017. Learned Sr. counsel further submits that since the Goat Market is being operated by respondent No.5 within in the area of Gram Panchayat, the petitioner is facing financial loss, therefore, he made complaint dated 22.01.2026 (Annexure- P/8) to respondent No.4, pursuant to which, respondent No.4 made communication to respondent No.3 vide Annexure-P/6. Subsequently, the petitioner also made complaint on 10.02.2026 to the Collector/Superintendent of Police, Distt. Mahasamund. Similar complaint was also made by Vice President, Nagar Panchayat Basna to the Collector, Distt. Mahasamund vide Annexure- P/7 on 19.01.2026. Despite that, no action has been taken by the Collector, who is the Chairperson of the District Animal Market Monitoring Committee. 3 Hence, learned Sr. counsel submits that, at this stage, this petition may be disposed of by directing the Collector to decide application dated 10.02.2026 submitted by the petitioner and Annexure-P/7 dated 19.01.2026 submitted by Vice President, Nagar Panchayat Basna, within stipulated period. 3. Learned counsel for the State submits that application dated 10.02.2026 and application dated 19.01.2026 (Annexure-P/7) submitted by respective parties recently, are under consideration and the same shall be decided in accordance with law. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Having considered the limited prayer made by learned counsel for the petitioner and the submission made on behalf of the State, this petition is disposed of at this stage, with a direction to the Collector/ Chairperson of the District Animal Market Monitoring Committee, Mahasamund to consider and decide aforesaid applications submitted by the petitioner as well as by the Vice President of Nagar Panchayat Basna, expeditiously, strictly in accordance with law, preferably within a period of 30 days from the date of receipt of a copy of this order, after affording due opportunity of hearing to the parties. 6.
