JUSTICE S.R.KRISHNA KUMAR - 3 - HC-KAR NC: 2026:KHC:21763 WP No. 8629 of 2026 ORAL ORDER In this petition, the petitioner has sought for the following reliefs: 1) “A writ of mandamus directing the respondents to disburse the following pending dues of the petitioner as on the date of his superannuation, with interest from the date of superannuation till the date of actual payment. a. Privilege leave encashment with interest at the rate of 7% p.a. b. Provident Fund accumulated in the account of the petitioner with interest at the rate of 12% p.a. c. Payment of interest on delayed payment of Gratuity at the rate of 10% p.a. 2) Award the costs of the present writ petition and incidental expenses in favour of the petitioner and against the respondents. 3) To issue such other writ, order, or direction as this Hon'ble Court may deem fit to grant in the facts and circumstances of the case or as the situation demands in the interest of equity and justice". - 4 - HC-KAR NC: 2026:KHC:21763 WP No. 8629 of 2026 2. Heard learned counsel for the petitioner and learned counsel for the respondents and perused the material on record. 3. It is the grievance of the petitioner that his representation dated 09.02.2026 at Annexure-K submitted to the respondents has not been considered so far by them nor any order has been passed on the same. Under these circumstances, the petitioner is before this Court by way of the present petition. 4. Per contra, learned counsel for the respondents submits that if reasonable time is given, they would consider and pass necessary order on the said representation. 5. In view of the aforesaid facts and circumstances and rival submissions, the respondents are hereby directed to address the grievances of the petitioner and consider his representation dated 09.02.2026 at Annexure-K and pass appropriate order / take appropriate decision in accordance - 5 - HC-KAR NC: 2026:KHC:21763 WP No. 8629 of 2026 with law, within a period of eight weeks from the date of receipt of a copy of this order. 6.
