1. Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Chandil P.S. Case No.155 of 2025, for the alleged offences registered under Sections 318(4), 341(2), 336(3), 340(2), 274, 275 and 338 of Bharatiya Nyaya Sanhita, 2023, Sections 47(a)(d)(f), 52(a) of Excise Act and Sections 25(1-B)(a), 26 and 35 of Arms Act pending in the Court of learned Sub-Divisional Judicial Magistrate, Chandil.

Learned counsel appearing for the petitioner submits that it has been alleged that from the dwelling house of Ajay Gope @ Kanhaiya Gope certain empty liquor bottle and filled up bottles have been recovered and the allegations are made of making spurious liquor. He further submits that the name of the petitioner has come only on the confessional statement of Ajay Gope. He then submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.16 of the petition.

Learned counsel appearing for the State opposed the prayer and submits that from the dwelling house of Ajay Gope recovery of empty and filled up liquor bottles and others articles have been recovered.

Considering that the name of the petitioner has come only on the confessional statement and the petitioner has got no criminal antecedent as disclosed in paragraph No.16 of the petition and the co- accused person namely, Basudev Kevart @ Basudev Kaiwart @ Basudev has already been granted anticipatory bail by this Court in A.B.A. No. 2189 of 2026, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Chandil in connection with Chandil P.S. Case No.155 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
7. Accordingly, this application is disposed of.
