1. Affidavit of service filed in Court today be kept with the records.
2. None represents the Serampore Municipality despite notice.
3. The petitioner alleges that out of the total dues of Rs. 24 lakh, only Rs. 4 lakh has been released in its favour. No reason has been assigned for non- disbursal of the balance Rs. 20 lakh.
4. The petitioner claims to be a civil contractor and further claims that the said money is due to it on account of work performed by the petitioner in accordance with the work order issued by the Municipality.
5. In the absence of the Municipality, it is not possible for the Court to adjudicate the issue conclusively.
6. It appears that a representation from the end of the petitioner seeking disbursal of the balance amount
2 is pending consideration before the Municipality for a considerable period of time.
7. Without entering into the merits of the claim of the petitioner, the instant writ petition is disposed of by directing the Chairman of the Serampore Municipality to take a decision on the petitioner’s representation seeking payment of its due amount in accordance with law, after giving reasonable opportunity of hearing to the petitioner for production of all documents in support of the work performed by it. A reasoned order shall be passed and communicated to the petitioner.
8. A decision shall be taken by the Municipality at the earliest but positively within twelve weeks from the date of communication of this order.
9. If any amount is found due and payable, the same shall be disbursed without any further delay.
10. Learned advocate for the petitioner is directed to forward a copy of the subject representation along with all supporting documents to the aforesaid respondent at the time of communicating the order of the Court.
11. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
12. Certified copy of this order, if applied for, shall be made available to the parties.
