Rajinder Garg versus Anu Garg CMP No.5300 of 2026 FAO No.117 of 2017 [Disposed of Matter] 30.03.2026. Present: Mr. Aditya Singh Thakur, Advocate vice Mr. Vir Bahadur Verma, Advocate, for the applicant-appellant. Mr. Somesh Sharma, Advocate vice Mr. Karun Negi, Advocate, for the respondent. Applicant-appellant [Rajinder Garg] has filed the instant application praying for extending the time to comply with the compromise dated 27.12.2024, arrived at between the parties before Learned Mediator, which was approved by this Court on 08.01.2025, whereby, the applicant- appellant had agreed to pay a sum of Rupees One Crore Only [Rupees Forty Five Lakh to Respondent and Rupees Fifty Five Lakh to son] latest by 31.03.2026. It is submitted that out of Rupees One Crore, an amount of rupees Seventy Five Lakh already stands remitted to respondent and his son. It is averred that due to unexpected financial loss in business, the applicant-appellant [Rajinder Garg] in compliance of the judgment dated 08.01.2025 passed in FAO No.117 of 2017, has issued two post-dated cheques i.e. cheque bearing No.142927, dated 30.06.2026, amounting to Rs.10,00,000/- [Rupees Ten Lakh Only] and cheque bearing No.142926, dated 30.09.2026 amounting to Rs.15,00,000/- [Rupees Fifteen Lakh Only] to Learned Counsel for the Respondent in Court today in supersession of cheques earlier issued. 2. Upon listing of the application, Learned Vice Counsel for Respondents, Mr. Somesh Sharma, Advocate, acknowledges the receipt of two cheques, so as to ensure compliance of the compromise and the Judgment dated 08.01.2025 as per the extended time contained in the aforesaid cheque(s) [i.e. 30.09.2026]. On Instructions, Learned Vice Counsel does not oppose the prayer for extension of time also and states that no reply is intended to be filed to this application. 3. In aforesaid backdrop, as jointly agreed by the parties, through respective Learned Counsel(s), the applicant-appellant shall ensure compliance of the judgment dated 08.01.2025 on or before 15th October, 2026.
