Invoking 483 BNSS, petitioner, namely, Jahid Rahman, is seeking regular bail in connection with POCSO Case No. 19/2026 under Sections 137(2)/319(2)/64(2)(m)/351(3) of BNS, r/w Section 6/14/15 of the POCSO Act. Investigation resulted in a charge-sheet and registration of Special POCSO Case No. 19/2026 arising out of the Laharighat PS Case No. 226/2025. The allegation against the petitioner is that he entered into a relationship with the informant's daughter, misrepresenting his identity and subsequently, had physical relationship with her. There is also allegation about threatening to make her private photos viral and under such threats he again sexually assaulted her. Subsequently, the informant's daughter, who was the victim girl came to know about his real identity. The case is at the stage of trial and during which the informant and the victim girl have also been examined. In her testimony, the victim girl has stated about her earlier love affair with the accused but under a mistaken identity. She has also stated about threats by the accused- petitioner to make her photos viral and using that threat to commit sexual assault upon her. The learned Additional P.P. objects to the grant of bail, and the learned counsel for the informant adopts the submissions of the prosecution. Despite the length of detention and the progress of trial by way of Page No.# 3/3 examination of the victim and informant, considering the other materials, there are some concerns regarding the welfare and safety of the victim girl at this stage and therefore, the bail petition stands rejected at this stage.
