Mr. Sagar Saha … for the NCB Learned advocate for the petitioner submits that she has sufficient materials in her custody to show that the vehicle could not have plied and therefore seizure of different vehicle has been foisted upon her and she has been taken into custody on 5th December, 2025 by the NCB officials for alleged recovery of 137.8 kg of ganja. Learned advocate also submits that so far as the issue relating to vehicle is concerned, the same is a separate question of fact which requires an initial enquiry to be conducted. Learned advocate for the NCB opposes the prayer for bail. 2 Having regard to the point canvassed by the learned advocate for the petitioner, it would be, in the interest of justice, that the petitioner be well advised to canvass such issues before the learned Special Court, thereafter, if required, approach this case. Considering the above, at this stage, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is Rejected.
