2. The petitioners are apprehending their arrest in connection with Mango P.S. Case No.61 of 2026, for the alleged offences registered under Sections 115(2), 126(2), 305(a), 331(4), 352, 74 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of

learned Judicial Magistrate First Class, Jamshedpur.

Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in this case and the allegations are made of erecting wall in front of shop. He further submits that allegations are made of theft against the petitioners and that is of 28.01.2026 and even the allegation of outraging the modesty on the same day whereas the FIR has been lodged on
13.03.2026. He then submits that petitioners are owner of said shop in which the informant is doing the business of cloth. He next submits that there are case and counter case and for eviction of the said shop the petitioners have filed Original Suit No.22 of 2026 which is pending in the Court of learned Civil Judge Junior Division- 1, Jamshedpur. He also submits that proceedings under Section 126 of Bharatiya Nagarik Suraksha Sanhita, 2023, has also been instituted between the parties by the S.D.O. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposed the prayer and submits that allegations are made of theft and erecting wall in front of shop.

Learned counsel appearing for the Informant vehemently opposed the prayer and submits that serious allegation of theft from the shop of the informant is there and the argument advanced by
learned counsel appearing for the petitioners is that the shop of the petitioners is false as informant is having an agreement to sale of

that shop. On this ground, he submits that anticipatory bail may kindly be rejected.
6. Considering that the allegation of theft and outraging the modesty is of 28.01.2026 wherein the FIR has been lodged on
13.03.2026. The shop is said to be of the petitioners, however, that is in dispute and for that one Original Suit No.22 of 2026 is also pending for eviction and the dispute is further there in light of Section 126 of Bharatiya Nagarik Suraksha Sanhita, 2023 proceedings before the SDO and it has been pointed out that there are case and counter case. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioners.
7. Accordingly, the petitioners, above named, are hereby
directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate First Class, Jamshedpur in connection with Mango P.S. Case No.61 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita,
