1. Instant bail application has been filed by petitioner under Section 483 BNSS in connection with FIR No.182/2026 registered at Police Station Kishangarh Bas, District Khairthal-Tijara for offence under Sections 319(2), 318(4), 338, 336(2), 340(2), 112(2) of the BNS and Section 66-D of the IT Act. 2. It has been submitted by counsel for petitioner that petitioner is in custody since 22.05.2026 and after investigation, charge-sheet has been filed against the petitioner for offences under Sections 319(2), 318(4), 338, 336(3), 112(2), 340(2), 61(2) of the BNS and Section 66-D of the IT Act; petitioner does not have any criminal antecedents and other co-accused namely Abbash and Sarook Khan have already been released on bail, hence, petitioner be given benefit of bail. 3. Heard counsel for petitioner as well as learned Public Prosecutor and perused the material available on record. 4. Taking into consideration facts and circumstances of the present case and the fact that other co-accused namely Abbash and Sarook Khan have already been released on bail; after investigation, charge-sheet has been filed and petitioner is in custody since 22.05.2026; petitioner does not have any criminal antecedents and conclusion of trial will take considerable time, but without commenting on merits of the case, this Court deems it just and proper to release the petitioner on bail. 5. Accordingly, the bail application is allowed and it is ordered that the accused-petitioner Jakariya @ Jiku S/o Aas Mohammad, shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so. 6.
However, it is hereby observed that if petitioner repeats similar nature of offence, during bail granted by this Court or breach of this condition is reported or come to the notice of the Court, the same shall be a reason for the trial Court to cancel the bail, granted by this Court.
