The petition challenges order below Exhibit 555 passed in Special Civil Suit No. 28/2019, passed on 08.09.2026. 2. Mr. Khajanchi, learned Counsel for the petitioner points out that as has been observed by the Trial Court, the copies of the documents have already filed on record, but only the certified or original copies of the said documents were sought to be filed on record. It seems that the Trial Court has swayed away by fact that the said documents would be proved during the evidence. The approach of the Trial Court seems to be erroneous, apart from being incorrect to the well-settled principles of law. In that view of the matter, following order is passed: (2) 2 wp 7714-2026 ORDER i) The order dated 08.09.2026, passed by 2nd Joint Civil Judge Senior Division, Chandrapur, below application Exh.555, in Special Civil Suit No. 28/2019, is quashed and set aside. ii) The Trial Court is directed to decide the application at Exhibit 555 again, after granting an opportunity of hearing to the parties. 3.
