Wasim Akram Ms. Sabrina Parveen …for the petitioner Mr. Suman De Mr. Kunal Ganguly …for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. Charge sheet has been submitted. Learned counsel appearing on behalf of the State submits that the application for anticipatory bail of three other co-accused was earlier rejected by this Court. The petitioner stands on the same footing. The petitioner, along with others, was transporting contraband across the Bangladesh border. When they were challenged by the BSF, they allegedly hurled grenades and fled away. While they were coming back, they were identified and named by local witnesses. Considering the above, the other materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.
