learned counsel for the informant and learned APP for the State.
2. In the present case, the petitioner seeks bail in connection with Khanpur P.S. Case No. 286 of 2025, registered for the offences under Sections 103(1), 61(2), 3(5) of the BNS and Section 27 of the Arms Act.
3. As per the prosecution case, petitioner and other coaccused persons chased the brother of the informant and coaccused persons Sonu Kumar and Monu Kumar stopped him at gun point and at instigation of coaccused Jay Kumar Chaudhary, Sonu Kumar shot dead the brother of the informant and the miscreants fled away from the spot.
4. Learned senior counsel appearing on behalf of the
Patna High Court CR. MISC. No.25650 of 2026(2) dt.17-04-2026 2/3 petitioner submits that the petitioner is innocent and he has been falsely implicated in this case due to political rivalry. The petitioner is aged about 70 years and he was at his house at the time of alleged occurrence. The petitioner and other coaccused persons have been named by the informant in general and omnibus manner. There is no allegation of assault against this petitioner and the assailant of deceased is coaccused Sonu Kumar. Learned senior counsel further submits that the allegations are not believable and the informant does not appear to be an eye witness. The petitioner is having clean antecedent and he is in custody since 26.12.2025.
5. Learned APP appearing for the State as well as
learned counsel for the informant vehemently oppose the submission made on behalf of the petitioner. Learned counsel for the informant submits that the petitioner is named in the FIR and he along with his family members in conspiracy with each other shot dead the brother of the informant.
6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the vague and doubtful nature of allegation against the petitioner and also considering his age, his period of custody and submission of charge sheet against him, the petitioner is directed

No.25650 of 2026(2) dt.17-04-2026 3/3 to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned JMFC, Samastipur/concerned court, in connection with Khanpur P.S. Case No. 286 of 2025, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions: (i) One of the bailors will be a close relative of the petitioner. (ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
