Case No. 171 of 2025 for the offence registered under Sections 96 and 137(2) of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Chief Judicial Magistrate, Pakur, is pressed into motion. It is submitted by the learned senior counsel on behalf of petitioner that as per the date of birth of the victim appearing in the annual Board examination, was 10.04.2008 and therefore, she was 17 years and 07 months at the time of incident. The petitioner is aged about 20 years and there is no allegation of sexual assault against him. Further, there is no material to show that any inducement was made on the part of the petitioner. Learned A.P.P. opposed the bail petition. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
